What Reid did was retaliation for the unprecedented obstructionism of lower level judicial picks. I don’t know if it was a good idea, but given the state of the GOP, I think it’s pretty naive to believe they wouldn’t have eliminated the filibuster for Supreme Court picks once they had the presidency again anyway.

Those centuries of precedent have been unraveling at least since Newt Gingrich became speaker, and I’m sure you can find traces before then. That involves actions from both parties, but there’s a pretty clear trend. The mere fact that the GOP was willing to block so many nominees says that they weren’t worried too much about existing norms. And of course the nuclear option had only barely been defeated the last time the Republicans controlled both the presidency and the Senate, and three of the seven GOP members of the Gang of 14 were no longer in the Senate, and a 4th had announced she would retire at the end of the year.
So maybe the GOP would have held back, but I really doubt it.

Thi s next part I expect to be excoriated for, but screw it, I get to express my opinion too, and I’m not going to be intimidated by potential flames. I am glad that this president will have the opportunity to appoint one more conservative justice to the Court. I was pretty happy with the last one, and if the next one is similarly well-chosen, I have hope that a relatively ineffective and controversial presidency may nevertheless leave something of a positive legacy to the next couple of decades.

There are quite a few who are desparately trying to hold on to their senate seat and have to think mightily hard about what to do here. They have a Trump base, which is only 20-25% but it’s still 25%, and to get the rest to win, depends on their decision here. Because waiting on this might generate a huge vote in their favor from the middle ground, who knows, but I would expect your phone and everyone elses to blow up with polling vey soon.

I just replied to this thread, and expected flames in general because of the general bent of this forum and the direction of the comments.
I’ve found that the Justices, regardless of leaning, are conscientious jurists who try to follow the law and precedent, not the will of them that “hired” them. I’m not worried about that either way.

The term banana republic refers to a politically unstable government established by the current ruling class and able to be toppled as soon as that class changes. That was clearly the sense in which I used it, and which you seemed to miss. The United States is clearly a stable government guided by the rule of law and built to whether any political storm, as evidenced by its survival through scores of political upheavals and changes of ruling “classes” throughout its history.
You seemed to have also missed that our system of checks and balances created a judicial system whereby the supreme arbiters of law, though per force nominated and confirmed by politicians, are insulated from political pressures. You also seem to have missed the fact that one party alone cannot install its favorite onto the high court. So, instead of being a mechanism for a political party to exert its influence beyond its elected term, the court becomes a bulwark of consistency that applies law and precedent according to long standing legal philosophy and not political ambition.

If all of that had been true, the death of this judge had only been about her life. Her achievements. Although this has been a topic, the main subject is that one of the two parties gets to appoint the judge. A judge who will have a lasting effect on the political bias of the court.
None of this should be possible in a proper democracy. The mere fact that politicians can appoint a judge is in itself as sign of fundamental problem of the system. In more modern democracies this cannot and does not happen.
Back in the 19th century the US was ahead of the curve. Yet, when others learned, adapted and improved, the US took its ancient constitution as gospel and got stuck in the past. We are witnessing the results as we speak. They are not pretty.

Well, your misconceptions, along with those who inaccurately believe they can effectively lobby the Supreme Court, notwithstanding, that is exactly what history has shown to be true. A US Sup reme Court nomination and confirmation centers on qualifications and underlying judicial philosophy, which is the only real way a nominating president can hope to indirectly influence court policy, as it should be.
With each passing decade, I become more and more convinced of the brilliance and foresight of those who framed our governmental system into one of accountability and adaptability while holding onto consistency and stability. If others think they can “improve” theirs by tying it more to the vagaries of social currents and prevailing political breezes, then I’ m happy to let them. Thankfully, it won’t affect the way we run ours .
