Who knows. I do know that when I sold cars, the most we could mark up a loan was 2 points legally. I don’t know if that was a MN thing, or a federal thing.

My girlfriend lawyer and I went through this conversation somewhat recently in regards to payday loans and the “mortgage” my mom had.
If I recall correctly, charging an absurd interest rate is illegal, however quite a few lenders try to circumvent lending laws by exploiting native sovereignty. So when the feds go “hold up, you can’t charge 700% interest” they just say “neener neener, my payday loan scam is based on a reservation so you can’t touch me”.
Of course, if lenders get stupidly brazen and greedy (like Scott Tucker) they earn themselves some RICO and TILA violations, lose their businesses, and get to spend a year in jail.
Sadly, there are still plenty of scams going on out there, even if they are technically or literally illegal.
