I'm wondering where the stream of obscenities was.

In all honesty, this is a lesson in how extreme a level you have to take defensive driving to when you're on a bike. You have to literally be prepared for every car to make a left in front of you, for every car to pull out of a side street in front of you, etc. the upside is that the defensive skills carry over to driving.

Hmm, was gonna reply but it'd only be a rewording of what you just said. When you ride you start noticing these things at a subconscious level - little tell-tales that somebody doesn't see you and you react to it before it becomes a danger. Of course, you can't predict everything and that's what the gear is for. This guy may have been hobbling a bit when he got up from that spill, but he did get right up (and hopefully stopped moving around once he got off the road!).

I'd blame the rain. By the time you could tell for certain that he was getting hit, any evasive action would have caused him to fall anyway - and in that case the Caddy could just drive off and it would be his fault.

You're exactly right. I've gotten to the point that it's almost like a 6th sense when a driver is about to do something stupid, it's saved my fiancée from being in several accidents in the car. That's not to brag, it's just to illustrate the point.

I will say though, when he got up I was expecting everyone in about 3 counties to get an education in swearing... At least thats what my reaction would be.

Its possible he could have avoided that. It isn't his fault, but bikers tend to have a 6th sense about this still. We all know people turning left into you is a huge hazard, and I knew what was going to happen here before it did. Regardless, this is why you wear all your gear! Dust yourself off, take some Advil, and get his insurance.

You have to ride/drive for the weather. The MSF teaches that a accidents are caused by a chain of events - weather, visibility, speed, anticipating the actions of cars etcetc. I'm not saying this guy is in any way at fault, but fault really doesn't matter when it's bike vs car.
