On my way home yesterday i got rear ended in my mustang. Kid was at fault, told the officer so, and he received a ticket. Anyway, fast forward to today and the kid's dad calls me and wants to just pay for my repairs. He says to take my car to the body shop and he'll pay for it with his credit card. I have all of his information, so i'm not too worried about that. Should i go this route, or should I involve my insurance? It's just the rear bumper, but i think it needs to be replaced. Is diminished value something i should be worried about? I'm not planning on selling this car for the foreseeable future. Any recommendations?
It's a 2013 Mustang GT for those wondering.

Find out if everything will be replaced with OEM Ford parts.

As long as you have a police report you can certainly take this route if you want. Trust me the insurance companies wont mind.
If the kid stiffs you you can still go after his insurance.

Well if you don't go through insurance does't that mean it's not on the carfax?
I have no idea, this is what I've been told. Have you gotten any estimates first?

Personally, if the structure is true I don't see why insurance needs to be involved - just adds more down time and nobody comes out happy. But if structural components are involved then it's a different story.
Then again not all damages can be seen immediately, sometimes a bumper is not just a bumper.

Take it to a body shop. Tell them to only use Ford OEM parts. If dude backs out on you then you go after his insurance.

Let him pay for it. More than likely the insurance won't do anything about the diminished value anyway. I'm 17 and have had one sort-of accident (backing out of parking space through another parking space and bumped an Evo.) I waited for the guy and exchanged info even though damage was minimal, and offered to pay since there was so little damage to his car. He was 18, and his mom forced him to involve insurance. Now I basically have no chance of having any fastish car before 25, all because this guy insisted on going through insurance for a $250 repair. It is his right, as it is yours, but it royally screwed me over.

I plan on that being the case. Looking at a Boss bumper and diffuser. He just said to get the estimate and he would pay on his cc.

That was my thought too. Kid's dad is the one initiating all of it. Kid was driving a brand new lexus IS 250.

Yeah, that's probably what i'm going to do. We shall see. I have his insurance policy information anyway, so my insurance would just recover from his. Definitely OEM parts though.

seems to just be the bumper cover, and nothing structurally. It didn't even look like my exhaust tips were moved.

I've been on that side of the deal too. I'm all for not messing with his insurance if possible. It was a mistake, and his dad is willing to step up to take care of it.

He was a good kid, just made a mistake. He was actually very sincere in his apology, and he owned up to his mistake. I will give him credit for that, and his dad called me later in the evening to check in with me. They have all be really good about it so far. We shall see if that continues.

Don't worry about the Carfax, just have it repaired in the way you think is best. I do like the idea of letting them pay for it as this way you'll have a better choice of where the car gets fixed and what parts are used. Just make sure Scumbag Steve's dad makes payment arrangements with the garage BEFORE they start the work.

Seems like it might work out but I would not be surprised if the guy gets shitty with you once he sees the numbers.
OEM Ford parts only, end of story. Chances are that's what your insurance company would have provided since the car is so new, but no guarantees if you are outside their watch.

yeah, well that is good then. I would give them the chance, but just be firm that if you get jerked around you will take it to the insurance. Set a deadline for the work to be completed and paid for by and stick to it. No excuses from the other side.

I think what some of the other guys said is right on - Get his insurance info (sound like you did); you can always reach out to them in the end if you have to and it will get handled that way. At the same time though, take photos and get a hardcopy estimate from a repair shop. That way if you do have it fixed but something happens (guy pulls his CC charge, etc) you have a paper trail and can show exactly what happened and deal with his insurance or otherwise.
But as long as he is good for it and willing to follow through, I'd just have the shop do the repairs and let him pay for it. Easy, no insurance, no reports, just get it fixed. The OEM bumper cover will likely be the only option anyway as it's too new for aftermarket replacements; there is a certain amount of time that has to go by before exact copies can be manufactured and sold.
Even though it is temping, if he is going to just pay the repair bill, I'd avoid trying to change things up. It introduces a potential mess and confusion and he might shy away from being so complacent. Just get it repaired back to how it was.

I will absolutely get the payment setup before the repairs are completed. I don't worry too much about the car fax. I don't really plan on selling the car, i plan on keeping it for a very long time, unless it gets totaled. Thanks for the info on the carfax though.

If they're willing to pay with no hassle, keep the insurance out of it. It will be quicker, and you won't have to worry about the insurance company dicking you around.

Not all the time. Some shops will report the incident via the VIN if the damage is high enough. A lot of times though, it might not get reported.

Honestly, he's probably trying to save his kid from escalated insurance costs. And I don't blame him at all. I'd go that route, have it fixed, and keep documentation of everything , including his offer to have it fixed.

Dunno how hard it hit, but make sure they check for any sort of frame bend. My mother's old 97 Camry was rear ended in a hit and run (mom chased the woman down too), and what looked like just a bumper was really 3k for a new bumper and to straighten the frame. Woman payed out of pocket, so my mom wouldn't call the police. Had the police been called, I assume this woman's license would have at least been suspended. Hit and runs are serious.

I'll tell the story again - my old Volvo died, and I borrowed my Dad's Dodge Coronet to go to a friend's wedding. Read ended by Sargent Shriver driving a Mercury Capri. His car totaled, the Dodge barely dented. His insurance company told us to take it wherever we wanted. The check was delivered two days later by messenger.

I got rear-ended by a kid a couple years ago while I was motionless at a stop light. Made a deal with his dad that I would skip the court date as long as he paid for everything before it came up. I don't remember if it went through his insurance or not, but I got a rental and got the car back 5 days before the court date and never paid a dime.
By the way, if you are going to rear end somebody, don't rear end a nine year old Mercedes. Cost him north of $6k.
