Hmm, I thought the Stolen Valor Act had been ruled unconstitutional: https://en.wikipedia.org/wiki/United_States_v._Alvarez (not that it makes this guy any less slimy). Guess they passed a new one that this guy qualifies for.
Theft is clearly not legal though...

He’d be ideal.

I thought prison was supposed to be punative? Not living in Scranton for 17 years seems like a win

12 years in prison plus 4 years probation AND return the money?
Seems a bit harsh. But also, fuck that guy.

Look at the bottom of the article. They revised the act to only apply to people who claimed
certain awards/honors and gained something from that claim

Yep, I’ve refreshed my memory now.

I’m on board with this guy being punished.
That said, 12 years followed by 4 years of probation will turn this guy, a thief and a coward, into a career criminal with little hope of ever being free of the “system .” $17,000, in the grand scheme of things, is nothing. Especially considering it will cost an average of $31,000 a year (national average) to keep him locked up. That means that taxpayers are going to pay a corporation $372,000 ov er his 12 year stay. For stealing $17,000. The math doesn’t work. It is an amount that is too small to ruin a person’s life over. How is he supposed to provide restitution for is crimes when he is locked up and then when he is unable to find work after his jail time ends due to the felony on his record? Couple that with the overly aggressive probation/parole system we have in this country and this asshole will be costing the state way more than what he stole.

Identity theft is not a joke, Jim!

Of course he was one of those weirdos that jumped the fence in boot camp.

Joe Biden will fight you!
Though it’s worth noting he was a senator from Delaware, not Pennsylvania.

I think it got revised. As I understood it the Stolen Valor act was originally intended to go after anyone who lied about being in the military/ went around in military uniform.
It is still illegal to pose as a veteran to get certain benefits, I think. The main thing in this particular case is that he stole 10K from where he was working, not that he lied about being wounded in Iraq.
This is me being a barracks law yer so take with a grain of salt.

I drove through Scranton once as a younger man and was struck by how unattractive it was.

I’d say it’s a good start.

That happened here too. It was a civil case not a criminal case.

I spent 2 years doing auto liability claims in many US cities and PA cities were objectivly the worst to do claims in

Something. I understan d peop le need top be punished for committing crimes. I also thi nk those punishments need to fit the crime. I don’t think a single person who stole $17,000 should cost the people who happen to live in his state $375,000 in preparation for his likely recidivism (43% rate of recidivism for non-violent criminals). Keep in mind that rate is so high because people make money from the incarceration of other people in this country. There is a monetary incentive to keep people in jail. That speaks volumes about the depths to which this country has sunk.

That’s quite a story. The PA guy’s story made me mad so I vented by posting it.

Right - it was rewritten specifically address fraud for material gain, not just immature adults with self esteem issues playing dress-up.

I was thinking that a more appropriate punishment for him might be to embed him with a Marine unit in Afghanistan and let him go driving around looking for IEDs.

I’d be worried this walking clusterfuck would get some Marines killed. I guess he could be useful as sniper bait.
