As long as they install it correctly (I’m sure they do). When we took our daughter home, the hospital guys insisted on helping install our car seat in view of their cameras. We patiently waited , then pulled 20 feet away into a parking space and installed it properly so that our baby wouldn’t become a missile in a fender bender.

I used to work in Berkshire County, but its been awhile. I think you used to be allowed to have it out if you were using it for directions.

When I lived in the Worcester  area I could have sworn you were allowed to have it in a mount for maps but touching it was a no-no. Either way it’s not like they enforced it other than slapping it on in addition to whatever else got you pulled over/caused the accident.

For what it’s worth, I don’t give anyone else my phone either. That said, I’ve met dozens of people for whom this would be a critical service if they’re going to abide by a hands free law. There are plenty of Americans for whom the instructions might as well be in Mandarin for as much hope as they have of getting it paired..

That’s actually exactly how that works. The Constitution protects you from unreasonable search and seizure. Willingly handing over property makes it fair game. Not that cops  pairing blue tooth phones on an east coast island populated by old people are going to be searching for crimes.

Nope. If I were a cop and someone handed me a phone to look at, let’s say, a screenshot, and I immediately went and looked through their emails, that would immediately get thrown out in court as an improper search if I were to find anything . Same deal with your house. Cop comes in and you say, okay, you’re allowed in the front room, but then he goes digging through your basement. Both are violations of your rights, 100%. If a cop wants to dig any deeper, they need a warrant.

Even phones seized off of accused persons require a warrant for their data to be searched. People got rights.

T here’s nothing immediate about anything in a US court, and anything a cop sees is permissi ble in court if you grant them access (assuming you have authority to grant them access) . As far as electronics at points of entry, the US govern ment has long claimed that the 4th Amendment doesn’t apply at ports of entry. “P orts of entry” extend to about a hundred miles from the actual border. I’ve had my car searched by Border Patrol agents. They don’t ask. If you refuse you’re probably going to end up sitting in a tent in t he middle of the desert. If you refuse to hand over a phone, they’re going to get it from you, and you’ll probably be detained . The law in this regard is far from settled. While LE does need a warrant to access electronics if you’re convicted of a crime, it’s a grey area at points of entry. While this may not seem evident at our northern border, it’s pretty obvi ous that the feds don’t give a shit ab out the 4th Amendment on our southern border. The bill actually says this:

Section 13B. (a) No operator of a motor vehicle shall hold a mobile electronic device. No operator of a motor vehicle shall use a mobile electronic device unless the device is being used in hands-free mode. No operator of a motor vehicle shall read or view text, images or video displayed on a mobile electronic device; provided, however, that an operator may view a map generated by a navigation system or application on a mobile electronic device that is mounted on or affixed to a vehicle’s windshield, dashboard or center console in a manner that does not impede the operation of the motor vehicle

So, it’s not a problem if it’s in your pocket, or in your car. But the driver can’t hold it, and it can’t show anything other than GPS (seems like even notifications could technically get you in trouble. Android Auto on my phone doesn’t show texts, but does notify you and pops up music information both of which would be illegal to read, though I don’t know how the state of Massachusetts could prove I read them, even if an officer somehow clearly saw them pop up).

I don’t think so. There was at least one previous attempt to pass such a law that failed. Massachusetts is the last state in New England to pass a hands free driving law.
