I heard from an unofficial ICBC source (my insurer) that the CX-3 is a total. While I am elated, part of me is skeptical until I hold that tasty cheque in my hands.
Update II: Right after posting, yep. It’s gone.

One more thing, I was concerned that the “biohazard team” missed what appears to be a not insignificant quantity of blood spatter on the passenger seat, passenger door, passenger carpet and passenger trim. That seat will need to be fully replaced as the material (perforated leather and suede) cannot be cleaned enough to mitigate the risk of Hepatitis B or C and HIV.

Beyond that, I called and left a voicemail for my adjuster today asking for the Manager of the theft unit to call as, due to where things stood at the time, it was nearly a month since the theft, our rental coverage is totally out and we still have no idea what they were planning on doing with car. Which, I implied, could be considered bad faith.
I then almost immediatly received a call from another ICBC office (they have local claims centres) who told me to pick up the items from the car that were not stolen. She’s the one who confirmed with me that it is a total loss.
So now what’s the plan? Negotiate with them. Settle, buy that Sportwagen. The games have just begun now that it is time to talk money.

when then told me my SX4 was a total loss, the guy tells me well you can start shopping. I asked him ok, what amount am I getting. He told me he didn’t know, so I waited a month till i got the official amount then boug ht the pathfinder.

I’m gonna say your letter got a reply in the final result.
Hey, let me ask you for your thoughts, if you don’t mind. I know you’re in Canada and the system may be different there is important ways, but here it is anyway. End of July, I was picking my wife up at the airport, and a a guy in his ‘93 Saab ran his nose into my fender/bumper trying to edge in front of me in the pick up lanes. I wasn’t changing my lane, just inching forward, and I think he misjudged the gap he had to dart in front of me. The cop there took pics and brokered the info transfer, but didn’t file a full accident report, just an incident report because the incident was very low speed.
Anyway, I filed a claim with the other guy’s insurance, State Farm of Illinois, because it was all his doing. They took my statement over the phone, and I’ve been waiting to hear back. I’m cynical and think they’ll come up with some reason to deny my claim. I’m thinking of writing a rollup letter, sending pics, and reminding them that the cops have a file also with pics on the scene. I want to discourage them from trying to weasel out.
My reasoning comes from the fact that in a previous accident where another girl ran into my wife, and it was totally the girl’s fault, the girl’s dad’s insurance tried to deny the claim with some bs about how my wife should have been able to do more to avoid the accident, so that made her partially at fault. I had to strongly imply that that wouldn’t hold up in arbitration, and they changed their mind rather than get further into it. I’m thinking of the same thing here, but more preemptively . Thoughts on whether that will help?

Personally, my honest advice is to never go through other peoples insurance. Always go first party and subrogate. Why have somebody else’s insurer help you? They have no financial ties to you.
I would say that the “aggressive ” approach is probably the way to go. Keep on them, be reasonable yet firm. Overwhelm them with photos, diagrams, photos of the crash area and witness statements .

Thanks. I think this is good advice that I should have thought of from the start. Now that I’ve done what I have, I’ll see what happens, and if I need to, I’ll file my claim with USAA and let them go after the other guy’s insurance for it.

Also, this may not apply as much in Auto, but if I damaged your home and you went through my CGL cover, my insurers only owe you ACV (actual cash value) or depreciated amount .
Whereas , most homeowners policies are on a replacement cost (new for old) basis.
