Seeing how simpleminded our justice system can be here in the States, I would imagine it would be a living nightmare getting this resolved if arrested on suspicion alone.

The next year, a New York woman was charged with driving under the influence after she registered a blood alcohol level that was more than four times the legal limit, CNN reported. A judge dismissed the charges after being shown evidence that she had auto-brewery syndrome.
It seems to be possible to have the charges dismissed.

It's still a financial and time consuming headache for the accused. She could have lost her job just trying to defend herself.

I mean, if she was intoxicated enough for it to affect her driving, does it really matter where it was brewed? Dismissing the charge would make sense if the charge was about having open containers of alcohol in the vehicle, but I don’t see why being afflicted with this syndrome should get you off the hook for driving under the influence. Seems to me that if you know you have this syndrome, then you need to be very strategic about what you eat and/or when you drive .

I think you can argue she had no criminal intent. I also think she did not know she had the syndrome, and it was diagnosed after the event.

The Independent article credited her story to CNN, but failed to provide an actual link. I think I found it . Details are sparse though; I can’t confirm the timeline. At any rate, her driving must have been bad enough to warrant a traffic stop. I hope she didn’t hit anything.
