Kinja'd!!!

I get people commenting on my videos daily about how the Supreme Court has ruled you do not need a driver’s license in the US to drive on the roads so long as you are not doing it commercially. But no one can ever show me the case.

So, today I throw out a hundo and will give it to the first person to send me the citation to this Holy Grail case. Have any kooky friends who believe this? Please share my video with them.

Thanks!

Steve

in all seriousness, I saw one of these morons a few months ago driving up Groesbeck in an Explorer (like yours.) instead of an MI license plate it had one which put a big “ 18 U.S. C. § 242" on it, and the magic words “Private” “Not for commercial use” as well.

this is one of the worst things about US culture.  we tell people their “gut feeling” (no matter how uninformed or just plain stupid) is worth more than actual facts.

US culture has a strange yet pervasive attitude that expertise and knowledge are to be distrusted.  for example, in many other countries, being an engineer is considered a trusted, honored profession.  here?  I’ve lost count of how many times I’ve heard morons grumble about “those stupid engineers” because something doesn’t work the way they think it should. we tell people to trust their “gut feelings” even if they’re drooling idiots.

OK I’ll take the bait... (pretty sure it was sarcasm tho)

Individual states have the right to require the use of driver’s licenses to operate motor vehicles. Every state requires a drivers licence to operate a motor vehicle, by law. Federal law stipulates that states have the rights to enforce such laws.

Is this you Leo?

Which totally misses the point that when working with legislation, you go with the definitions in the act first, after which using legal definitions from law dictionaries may be appropriate. However, a 1902 dictionary won’t get you far.

Instead, we also get cancerous people who think essential oils cure everything and vaccines give your kids autism.

Ah yes, because your doctor totally spent 8 years of their life and six figures becoming an expert in medical science just to lie to you. Becky down the street totally knows what your doctor doesn’t want you to know.

Ugh... Don’t these people know that before vaccines and modern medicine humans had a lifespan of about  40 years and there were like a billion diseases waiting to pick you off even earlier than that? Children today don't have to worry about Polio.

If Steve Jobs didn’t buy in to that he’d probably still be alive today.

Vaccinate your kids. I don’t know why that’s so hard for people nowadays. Kid’s allergic to vaccines? Fine, that’s why other kids need vaccines so the herd immunity protects yours.

Hey Steve, can I get partial credit?

Arizona DREAM Act Colaition, et al v. Brewer, 16-1180, 9th Circuit.

It was ruled that a state may NOT refuse and MUST issue a driver’s license to any person who meets reasonable qualifications and is defined by federal law as someone who is legally present . The state MAY NOT refuse to issue drivers licenses on spurious grounds, such as just deciding to redefine federal law because the governor is a bigoted, racist piece of shit.

Also that drivers licenses are a required component to operate a motor vehicle, and refusal of them renders the petitioners unable to legally operate a motor vehicle.

Original docket 2:12-cv-02546 (D. Ariz.) Upheld on appeal by the 9th Circuit, petition to the Supreme Court denied hard .

When I worked in NM, many would only recognize the jurisdiction of the county sheriffs, as that was the only branch referred to in the NM Constitution. Likewise, tax laws are only written for Virgin Islands Businessmen, duh.

Well there’s some give and take on that. I was replacing a front leaf spring drive bracket on a newer Western Star the other day. It sits under the frame and is held on by five bolts. One won’t come out because it smashes into the radiator, and half of the front of the truck bolts to the radiator support, hood, grille, etc. The nuts on two of the other bolts are obstructed by the welded-in sleeves that stop two other bolts from crushing the frame, so you can only get at them by reaching in with the open end of a wrench. 3/4" fine thread, t orque spec is 200-240 lb-ft, the nuts are distorted thread, and there’s almost no way to hold the wrench on the nut, especially when you’re stretching your wrench smashing that much torque against the open end of it. I’m sure some EIT was super proud of that bracket, but there would’ve been a hell of a lot fewer techs swearing at him if he’d just moved those two sleeves and bolt holes a half inch further out so you could get a socket onto the nuts . And the reason I had to pull the bracket? Because the retaining bolts for the spring pin   were bent and needed to be replaced, but they drop through the spring bracket so you can’t pull them out because the frame sits on top of them.

I get that there are frequently design constraints that the tech is unaware of, and that things are built for quick assembly, not repair. I started out life headed into engineering, and only dropped out because I ran out of money. So I'm seen both sides of the tech vs engineer debacle.  I plan on going back once I’ve dug myself out of this mountain of student debt. B ut it really doesn’t say much for engineers when a quick leaf-spring change takes the better part of the day because you had to blow the whole truck apart because you couldn’t get at the fasteners, and half of the fasteners that you can get at are just a massive pain in the ass to undo, when with a touch more planning, it wouldn't have been that big a problem.

But it really doesn’t sa y much for engineers

see, it’s this painting with a broad brush that pisses me off.  The idea that what someone at one company did on one product somehow means we’re all incompetent.  I’ve never said people with the title of “engineer” haven’t made poor/shortsighted decisions.  But the actions of a few don’t justify the incessant shitting all over the profession.  It’s like the squawking about the Ranger’s oil filter location.  So many comments on various sites were little more than “hurr hurr dum enginers amirite” and “why didn’t those idiot engineers just put in a relocation kit?”  Well, because the program wouldn’t let those “idiot engineers” add $20 to the cost of each vehicle!  And yes, I know Billy Bob can bung one together himself in his backyard for $20 worth of parts, but when (not if) the thing fails in 2 months and hoses his engine down with hot oil, he’s SOL. Whereas the company has to spend hundreds of thousands of dollars on design and validation to make sure it won’t fail in two months, and if a bad unit does fail they have to pay for the repair.

Ahhh there’s the one. I was looking for someone to say that. Here we go. The Northstar was first implemented for the 1993 Allante, Eldorado, and Seville, all of which ride on different platforms (V, E, and K, respectively. All three are FWD, but are different platforms- that means all three have different packaging, so the components of each module had to be packed relatively tightly, and most components are shared between the three cars, but mounted differently in each one. So, where would you put the starter motor? There’s not a lot of space in there for it to be mounted under or alongside the engine like most other vehicles. It goes in the vee because there’s no other spot it would work, given the somewhat module architecture GM used for these vehicles.

Plus, changing the starter motor isn’t even that hard. People on Cadillac forums have done it as quickly as 45 minutes. The main problem with the starter is not the location, but in my opinion that it requires replacement more than once in a vehicle’s life, so the gripe should be with the people who designed the starter, not the engineers who put it where it is.

That’s definitely true. The problem is no one remembers the thousand things that are easy to fix , or the two thousand that aren’t but make sense why they aren’t, just the two or three that are a royal pain in the ass for no clear reason.

It’s funny. I’ve never found the Ranger to have a frustrating oil filter location. My old Jimmy though, which did have it relocated to under the front bumper, was a pain though, because of the tiny little access  door in the bumper that you couldn't get tools through if the filter was on good, which it always was. I'm pretty sure it would've been fine in the normal 4.3 location, too...

Driving is not a right. Using a vehicle on the public roads is not a right. You can legally own a vehicle without a license and you can use it without a license, but you cannot use it on public roads.

There’s a reason the driver’s license is also called a permit.

Kinja'd!!! Elhigh > Lawprotector
07/24/2019 at 12:16

Kinja'd!!!0

Williams vs. Fears appears to be more about taxation and doesn’t speak to the operation of motor vehicles at all - hardly surprising, since it dates to 1900. I’m not sure how it’s relevant since it addresses people going from one place to another and whether that shall be permitted - and it shall - but isn’t about how they go about it.

As to the others, I think you’re ranting.

The Driver’s license requirement isn’t about stepping on your rights, it’s about you proving that you can be trusted to exercise them responsibly. You have to pass a test on how to use the roads safely , you have to show that you are who you say you are, and ideally pass a quick examination that you know how to use a car.

This all sounds very practical and commonsense to me. Is any of this in any way an infringement on your rights? I suppose you could make the argument that it does, in that you are not permitted to exercise your right to travel however you like, but if you were to do so without first legally obtaining a permit then you would be stepping on others’ rights to use the roads with a reasonable expectation of competence and responsible operation from other drivers. It really isn’t about just your rights, it’s about everyone’s, and in the discussion of rights if you’re only going to focus on yours and not everyone’s then you’re going to lose.
