They keep it up. ALL. THE. TIME. My boss has one and I shudder every time I walk by it . Aero up with misaligned panels.

I drove past a parked model s the other day and the sunlight was hitting the solar panel on the roof in such a way that I thought they had stripped the paint, allowed it to rust, and cleared it.

I was going to snap a pic the following day to make a smartass post about Tesla being the new VW, but realized what I was really seeing when I went past the next day.

Still though. They're the new VW.

As McMike said, the spoiler on the non- performance Model Xes is fixed now . All of t he early built  ones did move, though.

Usually I hate stuff like this, but here is a case where more ridiculous is better. Probably because I don’t think I’ve ever seen one modified in any way.

On the HMI in the car go to: Settings>General>Usage and storage> douchemodes>aerodynamic def lector settings> rear spoiler> Deployed/Recessed.
