The neighbor’s tree is touching my Mom’s house and is making her back deck unusable (it’s always wet and sappy and slimy and gross). Is there any way to get the neighbors to pay to get it cut back?

I don’t believe you can force them to do that, but you are free to cut anything hanging over her property.

The way I understand it is you can cut back trees up to the property line, but I don’t believe the adjacent owner is responsible to trim on your side of the property line.

You can check your local city/township for particulars of your moms house, but that’s the way it’s been explained to me. If it’s over your property, you can cut it, but I don’t know how that works if you cut it back so much that the tree will die, so best to check local regulations.

ask neighbor nicely, give them a few days. If nothing done get chain saw and cut branches that cross the fence.

a quick research with google law offices says

By law, you have the right to trim branches and limbs that extend past the property line. However, the law only allows tree trimming and tree cutting up to the property line. You may not go onto the neighbor’s property or destroy the tree .

Here in the Netherlands, there are rules about how far a tree can hang over on the neighbo r’s property. D oes some similar rule exist in the your area ?

Came to say this. In Chicago we did that when their tree was practically growing on our side and they tried to complain to a neighbor who was a cop, and he told them they were wrong and to stop whining. Disclaimer: totally unbiased, not like he was our friend or anything......maybe

You can get an electric pole saw from Harbor Freight and do it yourself if you don’t want to hire somebody.

Afiak, if it overhangs your property you can cut it back to the property line without repercussion if they refuse to trim it.

Do a really terrible job cutting it back yourself and maybe it’ll just die. Definitely make sure you throw all cut off limbs over the fence.

Legally you can cut anything that goes over your property line. If a tree in your neighbors yard falls onto your home they are legally responsible as well.

Typically whatever is over the property line is yours to do with as you please. Hack away at that big boy and free your mother of her arboreal problem.

Call your local Code Enforcement department. Not necessarily as a complain, more just a question at first. They should be fully familiar with the local statutes (I bet this sort of call comes in to them daily).

If they say it’s the responsibility of the person who’s tree is rooted in their yard, take the word of the CE official to the neighbor. If they say it’s your mom’s problem, get up there with a pole saw and go to town (probably would be best to at least give the neighbor a courtesy call to let them know).

Once a tree touches the house from their property your grievance gains legal rights in most places. It grows distinct from lesser concerns over sightliness and disputable opinions. Find out the local regulations and then approach the neighbor with the weight of legal consequence behind you. Politely.

Use a professional tree service. That tree is leaning heavily towards the house with the vast majority appearing to be on your side of the property line. Another boon for having them pay to remove it as a nuisance and danger to jointly shared fence and her home.
