I haven’t posted here in a bit, largely because my schedule is oppressive. But oppressive in a good way. And Oppressive and Oppositelock come from the same Greek root Oppes - meaning “the giddiness one feels right before catastrophe.” Not sure about that. Been a long time since I studied ancient Greek.

I do still record videos and podcasts. In fact, my channels passed the two million download threshold recently. So that’s something. Most are about cars and the law but sometimes I wander into other topics. Like this week when I griped about the Postal Service.

Keep up the good work. You’re a credit to the organization.

Hey Steve, good to hear from you again! I’ve been following your podcasts, but commenting on YouTube is just... not my thing. Besides, you’re always so thorough anyway that I almost never have any questions.

I was almost about to contact you the other day, though. David Tracy had posted an article about Craigslist sellers claiming that their cars had “no rust”, and it got me thinking- what are the legal implications of that? Have you covered this topic before?

Not directly, but the question is whether a cursory inspection would show rust. I have talked about the perils of buying cars sight unseen off the internet. On some level, I’m starting to feel less sympathy for people who were claimed to be surprised by how they got ripped off by a stranger a few states away that they never met face-to-face.

I suspect David was not ripped off. But if he was, I’m sure he’d call me.

Yeah, seems that checking out the car in person would affect a buyer’s ability to claim having been deceived by the seller. The hypothetical situation of buying sight-unseen might make a more compelling case, but as you said, it’s hard to be supportive of someone who puts themselves at risk like that.

But I guess it wouldn’t matter much whether this was a Craigslist or an eBay purchase though, right? I imagine that sight-unseen (aside from whatever pictures the seller included in the ad) purchases are much more common on eBay. A seller might still claim that a car is rust-free, and be strategic about which angles to show of the car.

The only major difference I can think of is that Craigslist doesn’t offer any kind of “purchase protection” like eBay does (if that would even cover this sort of thing). Either way, it still seems like the buyer would have a good case against the seller, if he documented the condition of the vehicle upon delivery and saved a copy of the original ad.
