these people are the worst, though. if you do this because you can’t afford the sales tax, then what they hell are you doing buying such an expensive car? and if you can afford the sales tax and are just evading it because you can, then you’re just a dick knob.

So salty. I liked Ed’s video on the subject better.

It is/was a loophole, and it is against the spirit of the law, if not the letter. But those tax rates are genuinely absurd, and I can’t be mad at them for finding a technically legal way around it. Hopefully bringing this subject into the spotlight will inspire states to sit down and re-think their tax practices, instead of simply “cracking down”. Otherwise, it seems that moving to Montana really is the only solution.

I have to admit, I get very  grumpy when I see people talking about tax evasion. Just pay your damned taxes people.

(Primarily , ordering online without paying your state use tax. Suck it up and pay it. )

If so I don’t see what’s so egregious about it. a 6.5% ad valorem tax assessed at the time of sale is no different in concept to the 6.0% sales tax we pay in Michigan on almost all goods, cars included. If I pay the State of Michigan $1200 when I buy a $20k car, then someone buying a $200k car can easily cover the $12k sales tax. If they can’t, then they can’t afford the $200k car.

(edit: it’s apparently 7.0% now, but still)

Sales taxes are considered to be a mixed bag for a reason; one of the downsides is that they’re regressive. Even though everyone pays the same percentage of the purchase price, the more you have the marginal utility of money decreases (each additional dollar “means” less to you.)

of course, we’re talking YouTube “stars” who are a special kind of dumb. The types who will find a burst of popularity, make $200,000 on whatever video dreck they do, and immediately go out and buy a $200,000 car. Then, of course, act like geniuses because they found a way to avoid paying sales tax on it. Meanwhile, the high cost of ownership will eat up whatever money they have left over because they didn’t realize supercars have super expensive parts and maintenance.

Loophole implies a gap in the law. There is no gap. They are trying to rely on Montana law for something that is no longer in Montana. 

If the cars were kept in Montana there wouldn’t be anything wrong. But keeping the car in Georgia violates Georgia law. Montana law is irrelevant if the car is in Georgia after 30 days.

Yeah I have no interest in defending the YouTubers. Just trying to imagine being in that situation myself. It’s one thing to be pissy about not having done the proper research about what it really means to afford an expensive car. But it’s another thing for the state to not put a cap on how much it charges in taxes for what is still one car , taking up one parking space or car-length on the road, and wearing one (or two, depending on t he state) license plate.

I make sure to pay my online use tax because I think I’m on a list. Couple of years ago I somehow downloaded the tax form for 1998 filled the whole thing out without realizing it. Was like wow the state owes me a lot. Month later I get a letter saying I owe them like 400$ and I used the wrong form.

The year before that I tried to create my own loophole. The form asks if I paid taxes to any governments outside of the state of MI. So I put my federal taxes down cause the IRS is not located in MI. They did not agree with my logic.

Sounds like it’s capped to me. And it doesn’t sound any different than any other sales tax; it’s assessed to the buyer at the time of title transfer. Just like sales tax in MI. Ad valorem means “according to value,” same as a sales tax.

and I can’t stand Ed Bolian so I don’t really care what he thinks he’s entitled to do.

Yeah, I think that’s reasonable.

I honestly haven’t put any thought into what number such a cap should be set at, only that one should exist. I do think rich people should pay their fair share, but I don’t think it’s fair to charge them extra just because they can theoretically afford it. Considering what the money from these taxes is supposed to be going towards, these cars don’t leave much of a bigger footprint then our cheaper cars do.

Well I think we’ll have to agree to disagree on that point. I don’t take a “soak the rich” POV towards taxation, but neither do I support subsidizing the wealthy which is what capping sales tax basically is. Just like defining 1 year as “long term” w/r/t capital gains. all you have to do is sit on an investment for a year and one day, and only pay 15-20 % on the money you make off of it.

in the end, it’s just another way the middle class takes it in the shorts.
