You might lose a title one day but if it was in your name, that’s easy enough to fix. What if you lost the title to a car BEFORE you had it put into your name? It can be fixed - but it will take some work. And I explain today.
I’ve lost and replaced a title before. It’s pretty easy to do when you are the last titled owner. But from time to time someone calls me after they lost a title - but before they had put it into their own name.
It could just be really bad luck but I have also seen it when someone bought a project car or perhaps they were planning on skipping the title. I’ve warned about the perils of doing that - and this is one of the possible problems that can arise.
The state of Michigan has three basic ways you can get the title replaced - and put into your name - without the cooperation of the person who sold you the car. But none of them are easy. Here is the audio:

I just inherited two cars. Both are located and titled in a different state. I’d like to sell the one that is paid off, but make the final payments on the other and keep it. Any advice?

Both vehicles were placed in a trust for which I am the successor Trustee. I think selling one should be straightforward, but I’m worried about dealing with the title since my mom is no longer around to sign it and I’m not sure the trust is listed on the title.
The other gets more complicated. Oklahoma issues a title which shows her name, the Trust name, and the bank as a lien-holder. I plan to pay the car off or take over the payments, but I’m not sure that will be allowed without me taking a new loan. I can pull cash from the trust to pay off the car, but with a significant tax penalty. I’d like to leave the car under the sole ownership of the Trust so I don’t have to deal with getting another loan under my name, but I’m not sure that’s possible. Once I get all of this settled, then I have to deal with transferring the insurance.

A few years ago, I was looking at a Craigslist ad of a car that I liked, but the seller mentioned some mumbo-jumbo about not having a title, and the owner being overseas on military duty...
That was enough of a turn-off that I never bothered to go see the car or even call the guy. It’s good to know more about how involved the process of replacing a lost title could be.

Thanks for reminding me - I need to replace the title for a motorcycle I left with a friend to sell for me, then ended up keeping.

Sounds complicated but that’s what attorneys are for.

My mom’s attorney is working on the problem, but at her rates, I expect the full value of the old truck to be used up before I figure out how to get it sold. :(

there probably was no car, the “overseas on military duty” is almost always a scam.

Most likely. I was new to browsing CL at the time, and hadn’t seen that one yet. I spend a lot less time looking at ads like that now haha.

That’s the problem. Which is why they created the “last resort” method in MICH. At least for those cars that aren’t worth the costly effort, there is a way to do it cheaply.
