Classic Celica ad to offset a rant.
Farm labor contractors must register with the US Department of Labor to operate. I have a client who had never had a single violation until being cited in an investigation a couple of years ago, a case that we have been fighting and is headed for a hearing.
The application for registration asks how many workers are in the crews, and my client said 30, as she has always answered the question, becausr her harvest crews usually have about 30. DOL had always renewed her registration without incident. This year, they said the question asks for the total number of workers, and rejected her registration for a “knowing misrepresentation.” She normally employs a couple of hundred people, total, and they gave her no opportunity to correct the application. Meanwhile, they allow hundreds with prior records to operate.
It is clear that they are trying to put her out of business because she is fighting their citation. They are pissed that this Hispanic woman hired an attorney and is determined to defend herself and make the government prove that she broke the law. They want contractors to get the message that when accused, shut up and kiss the ring. Don’t make the government prove its case. All she wants is a hearing, and they are determined to shut her down.
Make no mistake. All kinds of law enforcement abuses power, not just cops on the street. This is a self-made Hispanic woman, and the government wants to destroy her livelihood just to make a point.
Thanks Trump! It is on your watch now. Sometimes, it is like being a Public Defender again.

Our former district attorney did the exact same thing to a friend of our family. Shut down the man’s business over some tiny violation (I don’t remember what but I could find out) and ruined his livelihood to prove a point.

Have you ever listened to the Reasonable Doubt podcast with Mark Geragos and Adam Corolla? I think you’d enjoy it.

Federal court, exciting! I had the pleasure/displeasure of sitting on a panel in Sacramento Superior court once, and getting called in to be a juror numerous times. Some of the things that make it to trial are ridiculous.

I think we have discussed this kind of “gotcha” regulation before. So counterproductive. Hope it goes well for your client.
