The victims are suing Snapchat (and suing the driver), the driver isn’t suing Snapchat.

Which is still a monumental reach, because there are uses for that filter that aren’t illegal (like if you’re passenger is using it, or you’re on a ferry or something else).

But the driver probably has no money, so they’re turning to Snapchat to get their medical bills paid. Fun times!

From my reading of the article it appears that the couple filing the lawsuit are not the ones who were trying to drive 100 mph. From what I get out of it, it appears that Wentworth Maynard was driving normally and was hit by Christal McGee. Christal was using Snapchat at the time in an attempt to get her filter to put 100 mph over the photograph when she hit Mr. Maynard. Mr. Maynard was severely injured in the accident and suffered brain damage. The Maynard’s have filed suit against the driver Christal McGee and against Snapchat.

Anybody can file a lawsuit about anything involving anyone. Vast majority get thrown out by the judge as soon as he looks at the paperwork. All the headlines say is X is filing a lawsuit against Y. We never hear when they all get thrown out as soon as the judge looks at the suit. That info isn’t as sensational or eyeball grabbing.
