Periscope enthusiast and part-time sober driver Whitney Beall has been sentenced for the batshit stunt she pulled late last year.

Assistant State Attorney Lori Winstead says 24-year-old Whitney Beall pleaded no contest last week to driving under the influence. She received a six-month license suspension, 10 days of vehicle impoundment and 12 months’ probation — all common for a first-time DUI. Winstead says Beall also received 150 hours of community service and 10 days of weekend work release because she flaunted her endangering the community.

Odd they wouldn't be equal or at least closer. No wonder nearly everyone on a suspended license still drives.

Yeah, but you also need to think about if the car belonged to her parents, or maybe (in other cases) a spouse. No need to punish the whole family and lock up the minivan and the car seats for six months because dad is a dumbass.

Yeah, I wasn’t really making a judgment about if impoundment was a good penalty. If I were able to rule by decree I’d probably not take personal property in escrow for a behavior crime, I’m a property rights dude. Not just because it might belong to someone else or be used as a joint asset, but also because it's a valuable piece they may need to sell to stay financially afloat and not get into a criminal debt spiral.

But, since it is in use, you'd think you'd want it logically in-line with the driving restrictions otherwise it doesn't really serve any purpose.

Is it because they charge daily impoundment fees that would change the financial burden?

I found the answer :

“Under Florida Statute Section 316.193(6)(d), after a DUI conviction the court is required to issue an order for the immobilization or impoundment of a vehicle. The required period to immobilize or impound the vehicle does not begin until the defendant has served any period of incarceration. In order words, this requirement of the defendant’s car being impounded or immobilized is required as a minimum mandatory requirement after a DUI conviction in Florida.”

“Many businesses throughout Hillsborough County provide a service to meet this requirement in which they will come to your home with “The Club.” “The Club” is a standard security device that is placed onto the steering wheel of the vehicle so that the vehicle can not be driven by the owner during the period of impoundment required by the court after a DUI Conviciton in Tampa, FL. The fees many of these private business charge can range from $150 for a 10 day impoundment to approximately $300 for a 90 day impoundment.”

Yeah, figured it had to do with that though I had no clue they just throw the club on there rather than physically impounding the vehicle. Interesting.

I can understand the practicality of what they do but that still isn’t a logical connection nor intellectually honest. Philosophically, criminal penalties are supposed to be assessed based on retribution, deterrence, incapacitation, and rehabilitation. Retribution, deterrence, and rehabilitation are pretty much neutral between impounding or license suspension so that leaves incapacitation. The only way that you can logically justify impoundment is if suspension is not sufficient to prevent them driving. Therefore the lengths should be identical.

I suppose you could make a weak argument that rehab takes place during the impound period; but that’s really weak if it’s only 10 days.

Note: I don't really care if a drunk gets their car impounded, just philosophizing a bit.
