As it currently stands our neighbors homeowners insurance says there is no reason to pay out in this scenario and its our responsibility to take care of the problem. We only have liability on the car so there is nothing we can do there.
Thankfully, at this point our neighbor has agreed to pay for the damages, but we’ll see how that goes.

Can’t make a big enough stink with their insurance? Seems like damage caused by their property should be covered. I mean, it’s not that uncommon for tree branches to fall on cars.

They claim since the property owner checks the property for trees with a professional with some degree of frequency its not negligence and because of that its an act of god.

I thought the whole point of homeowner’s insurance was to cover acts of god?! Half of this damn city got new roofs paid for by insurance companies when the last hail storm rolled through.

This is the time to look into small claims court. By the time you add in the additional costs for time off work, dealing with the repairs, etc., their insurance may get be more willing to talk.

From my understanding, the financial responsibility lies in where the tree lands, not where it was standing before it fell down.

I know this doesn’t make you feel better but “acts of God” is a pretty common escape clause. Otherwise known as “shit happens”. It has nothing to do with religion it just means that they insure things that aren’t random and statistical outliers. It’s sleazy to not cover something like this though and if I were the homeowner I’d be shopping around for new insurance

Have you taken it in for an estimate yet? And what are the home values like in your area? The reason I ask is that homeowner’s insurance deductibles can be a lot higher than those for auto insurance. (I have a $1800 deductible on mine.) It could be that it’ll end up being better for the neighbor to just pay for it than deal with then insurance anyway if the damage isn’t much more than their deductible.

It’s shitty, but the insurance company is correct. Unless you expressed concern over the tree previously, it’s your responsibility and your comprehensive would have covered it (had you had comprehensive). If their tree fell on your house during a storm, your homeowner’s insurance would have covered the damage.
Depending on how shitty you would like to get, I would ask for reports for each “professional” visit, or a least some confirmation that they were performed with some degree of regularity.

The tree falling question is actually very common and unless you’ve sent a certified report from an arborist it’s almost always the responsibility of the victim’s insurance. Unfortunately.
(My neighbor’s tree is rather ominously suspended over my kitchen so I’ve spent some time researching).

I’d just put a new windshield in it and call it good enough. If it isn’t worth keeping insurance coverage (other than liability), then it isn’t worth fixing cosmetic damage, or worth worrying about what it looks like.

I was told the same thing when a tree branch fell on our CR-V. It was parked on our townhouse’s property, as was the tree, but because it wasn’t rotten there was no course to be taken by the townhouse owner or insurance.
Thankfully we had full coverage on it, and I had parked my liability only Crown Vic in the garage that night...

Sorry to here this, i had the exact same thing happen to my 1989 Subaru xt and home owners did not cover it. Like you said “act of god” whatever.... my car had the roof collapse so I think it was in a bit worse shape than your Pontiac.

It sucks, but it’s a tree. It’s not a manmade structure that fell. Act of God sounds about right in this case. No one is to blame for a tree falling but God.

Do you have anything from the neighbor in writing to confirm that? Any witnesses to the oral promise? If you have their email address, you could always send a very nice email to confirm their agreement without expressly making it look like you are doing that (e.g., “Very sorry to hear that your insurance company refused coverage but we are very thankful that you have agreed to cover the repairs to our car. I will get three estimates on the repair costs and send them to you so we can discuss which shop I should use.”).

Not sure it’ll make you feel better, but when we had some tree work done at our house we asked about one heading toward the neighbors. He told us the same thing: since he was there looking at it, we were doing our diligence. If something did happen, act of God. So, you’re not getting screwed by their insurance.

That might depend on the relationship with the neighbors. He might not be able to take the insurance into court without taking the neighbor as well, and a couple grand might not be worth the relationship cost with someone he will be living next to for a while. Especially if the neighbor is already talking about making it right.
