I never understood how Warner could claim copyright given the song was originally published WAAAAYYYYYYYYYYYYYYYY before 1923 and therefore has been in the public domain for decades now. I guess they were just trying to screw over people who had no idea about how copyright works.

So far as I know, one may patent anything at anytime, as long as it hasn’t been patented before. Copyright and trademarks though may be invalid if whatever it is in question has already come into common useage. The smiley face is an example of that.
