Some off topic venting
I rent a condo and I do annual leases. The people in there now need to leave with 80 days remaining. Fine, you know what? Stuff happens i can work with that. So they are leaving on the 30th of this month and my thinking is; I’m not going to be a jerk and hold them responsible for the entire lease terms (the remaining 80 days) but ill just have them pay out the remaining 12 days on that month. Frankly, I think I am being very reasonable. And all I get back is FLACK.
“we don’t want to pay 12 days we aren’t in the place” or “how about instead we just make sure the place is clean and available anytime to show to new renters or buyers, would that work” and my favorite “My roommate didn’t know this was a 12 month lease and doesn’t like paying the extra money.”
Well you know what guys? Tough shit. Your adults and you’ve got to deal with it like adults.
Also, they’ve been burning wood in my gas fireplace and throwing darts at the wall.
/reasons I want to sell.

UPDATE: They are staying the entire lease now. They told me originally they were being transferred to a new location, i suspect they just found a place they like better.
pros: not having to deal with this crap until July.
Cons: Their deposit might not be enough to cover the animosity when it comes time for them to leave. Aka renter remodel.
Selling this stupid place.

You might point out that they have a legally binding contract, and you would be entirely within your rights to charge them for the
months
that they aren’t living there, not just the
days

I think you’re being very gracious considering you are within your rights to charge them for the entire lease. Does your state even require you to look for new tenets before their lease is up? You may have to lay a rent law smack down on those jabronis if they keep mouthing off.

Well, gas fireplace sounds like it needs to be cleaned out anyway....But for real wouldn’t it just be easier to turn on the gas fireplace than to build a wood fire in there? I just don’t understand some people.

My suggestions is, you should gently remind them of the terms of the lease that they signed and let them know that if they were not agreeable to your offer, you’d be more than happy to get your lawyer involved to ensure they fulfill the terms of their contract.

They’re logic was to heat the place with wood, despite it being illegal most days in Utah in the winter (unless wood is your only heat source) for air quality reasons because they got a bunch of wood cheap. Thing that really chaps my hide? There is a wood burning fireplace upstairs.

Ahh, I see the update now. Hopefully they don’t destroy it too badly when they move out.
Also, whats your best advice for breaking a lease? My wife and I are starting to do a little house hunting, probably looking to buy later this year, but our lease is through next March. She’s been in the apartment for 7 years now, and it’s pretty good as far as rentals go in my experience, but we’d like to finally get a place that’s ours. Thoughts?

My advice is to be unfront, forthcoming and honest. If you have been a good renter than the landlord will certainly take that into consideration. You may be asked to pay an early termination fee or to sign a new contract (depending on what contract is signed)...if she has been in there 7 years I suspect her original terms have expired and she is probably month to month anyway. From a landlords perspective, we just want not not pay mortgage on an empty property and for it to be taken care of. Anything she could do to facilitate those two goals would go a long way to helping make sure its an amicable arrangement.

Utah has unusual weather that traps cold air in the valley, as well as any pollution. Since the majority of PM2.5 and PM10 (Particulate matter of a certain size) is caused by wood burning and since breathing in PM is very bad for your health, there are green, yellow and red burn days...depending on the weather. Some days we have China like air quality.
Good news is that to escape it you just drive higher (aka, go skiing)

Well this is in an apartment complex, its run by a leasing company that has a bunch of apartment complexes in the DC area. But from what I understand the office at each building has some degree of autonomy.
As far as a contract, this place will do month to month, but it’s absurdly expensive. Our rent is $1770/mo plus utilities, the same unit monthly would be about $2200/mo plus utilities. So she has stayed on a lease since she’s been living there, and when we got married and I “officially” moved in, I joined her as a cosigner. We’ve been renewing every 12 or 18 months, depending on terms. We did an 18 month at the end of last year because they wouldn’t raise our rent.
So like I said, we aren’t really looking to move until later this year, or maybe even next. I was thinking about trying to ride it out and then move when the lease is up, but I don’t want to put myself in a position where we miss a good deal on a house because we’re locked in with this lease.
I’m thinking I might go talk to the front office one day, let them know we are starting to look and get some more information on their terms to break the lease.

That’s your best bet. Like I said, You have to assume that they deal with dickholes all day long ans so your best bet is to prove to them that you have their interests at heart and are willing to work with them to make it painless. Some say that giving more notice than needed is a bad idea and it certainly can be...but I hate the idea of assuming the worst in people. Sure you may get burned from time to time working under than pretense, at least you aren’t contributing the the generally shittiness of the world by doing so.

Thanks for the advice. My wife is out of town this week, but I’ll talk to her when she gets back and we’ll probably go down to the leasing office one night and talk to them.
