Lexus Suing Jim and John Thomas Over Design Infringement

Lexus is taking the Thomas brothers to court over the Predator movies with Lexus claiming they blatantly copied trademarked design elements in their film.

In a suit filed today in California, Lexus states that several elements of the Predator, from the mouth to the body cladding to the breathing vents, are all protected under intellectual property law.

"They've taken one of our cars and used our own design IP and claimed it as their own," Lexus's Irma Wiener to Opposite Lock. "If anyone puts [those design elements] on a creature in an unauthorized way, we have a right to defend it." Looking at the Predator movies, which is based on a joke about Rocky IV , several uniquely Lexus styling components have been redesigned or exaggerated. Other bits, like the mouth are incredibly close to other Lexus's – specifically NX – and that's where the automaker is taking issue.

How Lexus will prove that the Thomas' creation is more than just an elaborate (and expensive) movie is up to the lawyers, but the design obviously hit a sore spot for Lexus.

"They've created a movie creature, launched it in public, and that product has direct design elements copied from our car," says Wiener. "And it's protected under law."
