This will bum out many of the BMW-fanboys and used car sellers who lurk in these parts but I debunk the most common Lemon Law Myths in my latest episode of Lehto's Law . I was inspired by a frequent comment I get whenever I mention the law in one of my posts - !!!error: Indecipherable SUB-paragraph formatting!!!
There are a handful of the BMW guys who jump in and explain that BMWs are so superior to the regular cars peasants like you and me drive that even the "Lemon" BMWs are great purchases. Some of the stuff I have seen written on this topic is mind-boggling and not worth going into here. But I did go into it in my podcast, along with many other myths I hear on the topic (or have heard in my 23 years of practice).

Not a problem. "LAY-toe" is not even correct. In Finnish (which the name is) it is pronounced with a short "e" as in "let" - and the Finns pronounce the "h". So it is "LEH-toe."
But I talk too fast (and too American) to say it right.

I've been meaning to check that show out but haven't. Usually, lawyer-portrayals on TV don't go so well. (And are horribly unrealistic and difficult to watch.) But I'm hearing good things about that one.
If you are curious, the best "law" movie ever made was "Anatomy of a Murder." Without question, hands-down, best courtroom scenes ever shot for Hollywood.

You should, in a previous career I was a PI who specialized in accident investigations, and financial crimes that weren't big enough for the Police so the victims would go civil. I thought I'd seen every scam out there but I can't for the life of me figure out what his plan was setting up an accident on someone he wanted as a client.

I'll check it out but it might baffle me too. I have seen stuff that even had attorneys listed as consultants that included stuff that made no sense. Or entire John Grisham stories.
I suspect that an attorney might pitch someone a plot line and then some scriptwriters "punch" the script up to the point where it is fun and dramatic but no longer makes sense legally.

While I appreciate the podcast, I prefer reading. If something didn't come across clear I can quickly review what was written, compared to trying to get the right spot in a stream to listen again. Also managing a small lot of people, I get interrupted frequently, and will go back a sentence or two to refresh where I was, not practical in the pod cast. Please don't make this your normal method of delivery in the future, as I will be missing a substantial amount of your future content if you do.

I think the point of setting up an accident wasn't a legal scam but a way to create ties/gain the trust of the couple he wanted as clients. "Saul helped me when that accident happened, therefore he is trustworthy/fit to help me with my case"

Sorry about that. I do the podcasts every week AS WELL AS the articles I write. Sometimes the topics overlap and sometimes they don't. The articles are usually more specific than the podcasts since you can do that when writing.
I had a radio show years ago and the podcast thing is an extension of that.
I generally post the podcast announcements on Oppositelock each THURS morning to let people know that a new one is up. That post is usually seen by a handful of people over there and then it kind of fades away. This morning it got posted to the FP. Which I appreciate greatly. But I do see your point.

Scam was simple really - as a lawyer, he convinces the legitimate/intended client to pay the skate boarders and make them go away. This buys trust and potential client in future

Advising people to not purchase any auction cars whatsoever eliminates literally millions of cars from the market, to protect from the possibility of buying a very small portion of these cars (some fraction of a percent?). Used car dealers, for example, probably get 90-100% of their cars from auction unless they are tied to a new dealer for trades. But avoiding all auction cars probably would virtually eliminate all possibility of picking up a lemon.
I suppose for the risk averse client it's probably not that big of a deal if they're shopping for a Camry or F150 or something else very common, as there are plenty available to choose from.

Fellow Michigan attorney here. It's tough to watch lawyer/law movies. A Few Good Men used to be one of my favorite movies. Then I went to law school and, more importantly, got a few jury trials under my belt. Now the courtroom scenes are difficult to watch! Excuse me, Tom Cruise, but you can't just wax poetic while questioning a witness NOR can you turn to the jury and start talking directly to them, asking rhetorical questions and such! A great movie ruined for me!

I think the scam was going to work like this: skater gets hit by the treasurer's wife. They threaten to extort her for the "accident," Jimmy/Saul comes to her rescue (by driving by and stopping, I guess?), and he saves her from the attempted extortion. In turn, she'll feel gracious enough to hire him to represent her husband. (And I guess Jimmy/Saul gives the skaters a cut of his retainer to represent the husband, which would've been sizable.)

Basically his line of thinking was this:
1. Identify lady whose husband stole 1.5 million dollars from the government, and is looking for a lawyer.
2. Have dumb kid get hit by said lady.
3. Show up on the scene and act like he is on her side and that he will protect her legally in this giving him the knight in shining armor effect.
4. Because of number 3, land the job defending the family in the fraud case, which he can charge a stupid amount of money for.

What I like about you, Steve, is that even though you tell stories about bad dealers, you don't go so far as to say all dealers are bad.
I don't make shit because I lose money on deals trying to help people. I don't pressure them into buying anything or try to screw them over. I still end up seeing the "All dealerships are bad" crap all the time online, so I appreciate you not doing it.

I have bought many cars from various dealers in my life and can tell you that I recommend dealers all the time to people. Word of mouth - it's currency in this field and the good ones will benefit when the bad ones mess up.

Would have been neat to hustle that around Talladega Short Track. It's a dirt track right across from the Superspeedway. Oddly, both are actually in a town called Lincoln and about 10 minutes from Talladega proper. There's also a road course nearby named Talladega Grand Prix.

The sound alone would be worth the trip! You're right, getting it on the straight gives you a chance to wring it out a little before hitting a corner. I want to do what you did to that 'bird with the AMC Javelin sitting out by the IMHOF. I live about 25mi north of there for reference.

Great podcast Steve! I bought a 2005 Honda Odyssey and within the first month it needed new motor mounts and a new transmission (fluid was essentially leaking through the metal...guess a casting problem). I dont know if these guys had ever been sued or something but they went overboard on the courtesy and service to get the car fixed. I still have it today (paid for cars are hard to let go of). This was in SC. Great info in the pod and Im mentally filing it for when I do buy my next car.

Not always Managing, they come with questions and I answer. High end custom car work always requires multiple inputs to make sure the product is one we are all proud of. It's mostly a "Yes, that is great", but maintaining a constant review allows consistent image of product.

Sort of. He had one trial and that was declared a mistrial. He got a 2 nd one that didn't go as well as the first one was going and was convicted in 2000. Just last week they granted an appeal to determine if he received ineffective counsel due to the lawyer not following up with a possible alibi.
It's a pretty good listen. 12 episodes, anywhere between a 30 minutes to an hour each. I'm not finished yet, but it has been fascinating so far.

he was trying to get an injury pay out from the driver of the car on his clients, the skateboarders, they would get money for

he wanted to give the woman he talked to in the begining an ultimatum. either she pays out huge money to the skateboarder she hit, or she retains him as their lawyer about the money they surely embezzled. he knows they stole the money, but he knows he will be paid for his work to defend them, even if he cant win, he needs money and wants to be paid.

the idea was to run an injury scam, where he would take care of the injured persons problem, and the woman would hire him on retainer for her and her husbands company. if she refused, he would run her through the mill for as many items as he could, physical and mental pain and suffering, opportunity loss from not being able to skateboard anymore etc.

I have a question, and I understand the response almost certainly varies from state to state, so if you could answer for states you know about, that would be hugely helpful.
Many of us live in areas that are very close to other states. I live in Virginia close to Maryland, for example. I've bought two cars from Maryland dealers, but titled and registered in Virginia. Whose law, if any, applies here? I read the statutes and it looks to me, a total layman on the law, that I'm SOL if anything goes wrong, which thankfully has not happened.

I can tell you that in MICH, the lemon law covers residents who purchase elsewhere or non residents who purchase here. So you MIGHT have the option of picking which state's law you want to use. Consult a local attorney etc.

Sort of. My family is but I was born in the lower. My grandfather was the dean of Suomi College and we spent all our summers in the UP. I still go back as often as I can. Mainly to the Keweenaw but I love everything north of the bridge.

And those shows also make lawyering appear far more sexy and exciting than it usually really is. My wife is a physician at a teaching hospital. When she comes home, I ask her about her day because, well, it really is entertaining to hear about. When I come home, I dread being asked what I did today because "writing discovery requests" doesn't have the same cachet as "putting a man's intestines back in."
What I tell her is this: if you asked a glacier every day what it did that day, you would get some awfully boring answers. But if you would just wait a few (thousand) years and ask it what it's been up to then , you're probably going to hear a hell of a story.
I'd still watch Lehto Law, though. Even it was shot in real time.

Saul was trying to frame the wife of the client by staging a car accident.
This way, he could pretend to swoop in and do his lawyer things to get the wife out of the mess and impress her - so she and her husband would award him the other case about the $1.6mil embezzlement.
The accident happens, but the car speeds away. This is a hit and run, which is a felony.
So Saul was thinking since a more serious crime was committed, he would be able to shake them couple for a few extra bucks.
Also, Suzuki Esteems were very popular in India back in the 90s. They were sold as Sedans though, no coupes.

But you are quite right about the life of a lawyer. Generally a lot of paperwork (office) and waiting (in court) punctuated by a few moments of excitement.

Oh, I may have not made it as obvious but the people who say it is a GOOD idea to buy a lemon are always touting BMWs.
As for auctions, I am really just noting how careful you need to be about them. If you know what you are doing and or getting yourself into (ie., you REALLY know) then you can do ok. I just worry about those "auctioned by the manufacturer" notations in Carfax.

I am planing on leasing cars that were passed through auctions, and were previously used by BMWNA. I see some of them are press cars, but none of them (with several hundreds I have checked out so far) ever have a branded title.
Most of them were through Ohio auction, not sure if OH is one of the states that are leveraged by manufacturers to title wash.

I am curious to see what you find out about those. I suspect that a lot more "press" cars show up at auction than were actually used by the press.
True story: In Michigan, they can call pretty much anything they want a "program car." The car dealers went to Lansing and got the word redefined to mean almost anything, including a former rental vehicle.

Funny, I consider myself a car guy and my entire family is as well.
The only car I've known to be THE WORST. Not a broken tranny or 1 major reoccurring thing. BUT ALL PROBLEMS. Windows broke about 50 times, seriously. Switches on the interior molded and rotted (California dry?) Numerous other problems but the real issue was FAILED OIL PUMP.
Honestly of any other car the worst car I've known, it was a 2001 bmw 3 series. It was purchased brand new. I also personally have a friend who replaced his 335i fp 3-4 times before selling it.
BWW IS THE BEST...........at making Lemons.
