Astounding power of observation, sir. Those are in-fact not M3 convertibles. They are, however, race cars with no roof actively participating in racing events, much like my suggestion for the trashed high-mileage M3 convertible. But for whatever reason you feel as if there is some governing body that oversees all of racing and has written legislation suggesting a convertible M3 with a roll cage is not allowed to race never ever ever never.

As cheap as I am, I just can’t see throwing that much money at that Miata. That thing looks like it floated here from Fukushima. The BMW honestly doesn't look that bad to me. That's my choice.

You both escalated quickly....
There is no ruling saying an M3 convertible cannot be raced as long as it has a rollcage for rollover protection, same ruling for every convertible out there. Why you don’t see M3 convertibles with rollcages is probably because the hardtop is cheaper to pick up, and because it has a roof is probably a bit lighter and stiffer so in general it’s a better base to start with.
In short, a convertible M3 can be raced as long as there is a rollcage above the driver’s head, same as any other convertible/non-hardtop vehicle out there.

Oof, I’d have trouble if the M3 goes too much more above its current bid of $5001. It’s a good candidate to strip and cage, but you should be ready with a trailer and tow vehicle. It’s not going to be worth the hassle of getting a title for your new race car.
I mean, I’d still probably do it since serviceable E46s are going in the $15k+ range... but you have zero clue of the history of this car. Yikes.
