Seems NP, but I can't be sure.

Ideally I'd like 2010 or later but for that price and low miles that is tough to beat.

Low miles are excellent. I'd be more worried on the other without a warranty.

You could probably get that black one for a little under $30k. I'm not as huge a fan of garage queens, I think these cars are meant to be driven.

I'd still get a PPI done on both. You could find a facelift E90 (LCI) for $35k these days though. I like the taillights better on those plus the updated HDD based Navigation.

I would try to avoid 2008 due to intermittent motor problems, and the ugly, old iDrive. However, if you don't care about iDrive, and want to take a chance with the motor issues (that probably won't ever happen anyways), go for it!

The prices on both of them seem about right btw.

I love mine... Bought in 2012 with some remaining warranty.

Just know that it's an expensive car to run and maintain, so don't stretch yourself too thin to get into one. Mine hasn't given me much trouble, but I'm still glad I waited to get into a car like this until I could truly afford it (previous ride was an '05 Mazda 3s hatch, fwiw).

What's with the dual exhaust on that first listing?

The only dual exhaust for that car I know of is the Dinan R3 straight pipes.
