Purely Theoretical Titling Situation in Illinois

So say a friend needed to transfer a title, but it was a little late. Like, 25 years late. And the person the title is transferring from has not been with us for close to 19 of those years. But my friend still has the deceased's signature on the title for transfer, but a blank date spot.

Now I know the late fee for titles is something small, but the thing my friend is worried about is the back Use Tax (GOD, I HATE USE TAXES, but that's a rant for another day).

On a scale of 1-10, how theoretically screwed would my friend be?

Edit: the car in question has never been in road-worthy condition.

That is unusual to say the least. But this is the great state of Illinois with their infallible gov't, so who knows.

Probably not too screwed. Illinois' registration fees and used car sales tax really aren't too bad. I'm not aware of anything that says a vehicle must be registered, if its not in operation, so I don't think they'll make him pay for 25 years of registration.

Especially since the date is blank. I'd fill in a date within the last month. In that case, I give him a 1 on the screwed rating.

But the transferring person has been deceased for QUITE some time. Would that not raise red flags?

My friend is thinking of going to one of the lesser populated DMVs, maybe things could slide there...

Not screwed much at all. I did a title transfer 9 years after getting a car, because it wasn't on the road at the time of sale through just after the title transfer I didn't have any use back-taxes to pay.

Though the person helping me at the DMV was a person we dealt with a lot for work vehicles, your mileage may vary with a random DMV person.

Did he inherent the car? You might be able to do a Small Estate Affidavit. Inherited anon-working car never wanted/needed to register it. Could work.

I seriously doubt anybody at the Illinois DMV would check that. True story, a few years ago I was given a car by my parents. Dad signed the title, Mom didn't. When the clerk told me she needed to sign it as well, I told him I'd come back another day. He slid the title back to me and said, "Why don't you take it out to the parking lot, so she can sign it?" 15 minutes later, I had my new plates.

No, he bought it; and even so, I don't think there was a will. I was looking into the issue when the part:

Proof of compliance with the Vehicle Use Tax (RUT-50) and appropriate taxes as specified on the form, made payable to the Illinois Department of Revenue but submitted to the Office of the Secretary of State.

lead me to looking up the RUT-50, which refers to using Publication 103 for:

The following

formula is used to calculate interest

tax (+ penalty, if applicable) due x interest rate ÷ 365 =

daily interest amount x number of days = total interest due

With over 9100 days, depending on what the interest rate, that can turn into A VERY SCARY NUMBER.

Or my friend could be freaking out for nothing, and they won't even worry about back taxes and just charge the normal use tax.

This is exactly how I hope the situation is resolved. We had something similar with titling a trailer. The boat had one, the trailer did not. "Oh, can you name the components of what the trailer is made of?" *started naming parts: frame, wheels, axle, hoisting strap thingy, signals, etc* "Oh, so you built that right? Here's the form for a kit trailer."

Title 20 minutes later.
