I briefly considered posting this to !!!error: Indecipherable SUB-paragraph formatting!!! but then I considered the backlash against an irreverent post to an article in a generally LGBT friendly community. So I'm posting here instead. For the record, I think SC's DMV policy is bullshit but "I dress like this everyday" isn't a good excuse either.

I don't mean to be stirring it up but I thought I'd share my comments and thoughts in a place I'm less likely to be flamed for having an opinion that differs from Gawker Media at large. Maybe Ralph will comment, I know he lurks here.

Why won't people keep there idiosyncrasies private? Cross dressing is extremely prevalent among the normal citizens in the UK, but apparently it's done in outside of professional spheres of influence.

I dunno. In my opinion I feel like anything that gets in the way of facial recognition algorithms has to be removed. Male, female, transgender, whatever. Make that the goddamn rule, end of story. If you require a privacy screen because you are Harvey fucking Dent then so be it, but you don't get a free pass.
If you don't comply, no license.

The DMV wouldn't let him take his picture the way he showed up because they claimed he was wearing a disguise.
His response was "this is how I always look," i.e. disputing the DMV's claim that he was wearing a disguise. Which, in my opinion, is a pretty reasonable response to being accused of wearing a disguise. Not an excuse.
I'd say your problem is that you think he needs an excuse in the first place. Because really this is all just the DMV not knowing how to handle someone who doesn't conform to traditional gender norms, and reacting poorly.

It is the biased application of the policy that I think is bullshit, yes. That is also why I make the comparison to the goth clown kid (Jimmy from Raising Hope btw) since it's the extreme case of "I wear makeup like this every day." You can't use that as your excuse because it makes it easy for them to point to the policy.

Why should he or anyone else get special treatment? And keep in mind I am talking about facial recognition. Eyeliner, foundation, and such are no issue with that technology. Glasses and (I believe) beards are. He should have been able to keep the makeup just the same as any woman or man who decides to get scanned.

It's not special treatment. It's treating someone who happens to be different, the same as everyone else who is more in line with traditional gender norms.

The scanner does not care if you are male or female. There is no reason for any type of special treatment for anyone.

My comment:

is admittedly worded poorly to sound like he needs an excuse; he doesn't, and shouldn't have an excuse because none is necessary.
However, I still disagree with saying "I dress like this everyday" because it opens the door for someone to say "shape up, it's just a phase." (I'm playing the devil's advocate here)

This kid did not ask for special treatment.
He showed up to the DMV to have his picture taken for his driver's license, and unlike most people whose appearance is more in line with traditional gender expectations, he was told by the DMV his appearance was unacceptable.
The reason given by the DMV was that he was supposedly wearing a disguise. But a disguise is altering one's appearance for purposes of concealment. This kid wasn't concealing anything. He showed up at the DMV how he normally looks.
Asking to have one's driver's license picture taken while looking how one normally looks, just because that person's normal look is different from most other people's normal look, is not asking for special treatment.
The fact that you believe this constitutes special treatment, to me, is just disappointing.

How else should he have responded to being accused of wearing a disguise? He basically said, "no sir/ma'am I am not wearing a disguise, this is my normal appearance."

You are missing my point in its entirety. I am saying that nobody should have to remove anything that doesn't get in the way of their technology. Him or otherwise. It is considered good practice when you are collecting this type of data in the scientific field.
Do you understand the difference between facial recognition and a picture? The fact that you keep referring to it as a "picture" makes it sure seem like you don't.
If his make up or the make up of any other person coming in to the DMV gets in the way of the DMV getting an accurate scan of their face then it should come off. It should have nothing to do with his gender, race, sexual preference, or otherwise.

I think your bringing up facial recognition technology when it was never mentioned in the original article is confounding the issue somewhat.
Your original post read like "this kid could screw up facial recognition," and then even though you clarified it you kept saying "special treatment," which I got hung up on.
Anyway, we both (mostly) agree that the kid shouldn't have had to change his appearance.

For what it's worth, that's a big oversight in the main article.
What the SC DMV does (alongside other states) is take a kind of "digital map" of your face which is used for a variety of purposes by both the state and federal government. They don't just take a simple picture anymore, and certain things can confound that process. I am involved in this type of technology for a living (in another arena) and have seen this type of thing firsthand.
Even if it's not mentioned in the article it's what's going on behind the scenes (although that's not saying that the SC DMV was just in their request). Just as an aside, the last time I came in from Canada to the USA I had to remove my eyewear and go through a facial recognition screening for re-entry into the states. They don't call it that directly, but that's what it is.
And yes, I agree wholeheartedly that he should not have had to change his appearance- as long as they could accomplish what they needed to.

There is a subtle difference between "I look like this every day" and "I'm adhering to your policy." If the plan is to play hardball with a branch of the government, someone along the line will make this distinction. I was just trying to point that out and I guess I did a crap job of it.
