And I am ashamed to be a Virginian. I just found out that a friend of mine's son (sober 17 yr old)was involved in a car accident. That was bad enough, but the boy is okay. That's the good news. The bad news is that he was t-boned by a drunk with several previous convictions for DWI, enough convictions that he didn't even have a license; it had been suspended. Of course one of the best things about driving without a license is that all those silly little other laws like rules of the road and insurance no longer matter either. So, Mr drunken uninsured guy trashes the his car, my friends truck, and sends 2 of the other people in his car to the emergency via Medivac. Now, here is where reality ends and bullshitsville takes over. Apparently, the State's Attorney General has decided to charge my friend's son with the accident! The reason, you might ask? He has the insurance, therefore, he has to foot the bill. So, not only will his insurance have to cover the drunk, but because he is now being charged, it opens up the possibility of civil lawsuits for damages. I really don't have all the details, but I also don't want to pester my friend for them right now. Anyone have any links to where this type of info (accidents, charging, that type of related info) could be found?
Edit: An attorney has been retained already...

This is what the courts are for. If the State AG wants to press charges, and your friends kid is not at fault, then I don't see how the charges can stick. Being charged with, and convicted of, a crime are two different things.

My sister is an attorney now, but very similar situation she had. She was 17, driving a few towns away from my hometown. Got hit by a drunk driver, smashed up her turbo Laser pretty good. Guy gets out of the car, threatens my sisters life if she says he was driving. Cops show up, sober passenger in drivers seat. Sister tells the cops what happened to a T. Guy who hit her is the son of the police departments mechanic's son, so they go with his story. 5 time DWI loser, no license. My sister sued the shit out of the PD and won, and got the accident report as it should be. Fucking pisses me off to hear it again from you. Sorry to hear about this

WHAT!!! Did the cops not cite the drunkard? Did he not get arrested? I feel like there is a MAJOR case against the drunk and the AG / state.

You really cannot tell unless you have the accident report. Who gets charged with fault in a crash depends on what is in that report. It also depends on if you have comparative fault
I would be highly suspect of "He has the insurance, therefore, he has to foot the bill" as a motivation for being assigned complete fault in the crash. Unless the State Attorney is trying to throw the case before it even starts.

Yeah, gotta find that missing info. If the kid blew a light then got T-boned by a drunk driver, the kid would still be charged for causing the accident by virtue of running the light (as well as the other guy getting a DUI charge). If he was just abiding by the rules and got hit then the AG is off his rocker...but I kind of doubt that. More likely it's a he-said-she-said thing they may just be letting the courts sort it out, which will likely end up in your friend's favor as a suspended DUI fellow isn't really sympathetic.

Hell, in Long Island NY, a friend of mine's little brother was riding his bicycle in broad daylight and got killed by a drunk driver, who had an open bottle of vodka and a child in the car as well. Drunk got 8 months, served even less with good behavior, and is out and about with a new job. Meanwhile, my mom's exhusband goes ripping around town drunk almost every night in a car covered in dings and his buddies in the PD turn a blind eye. Maybe it's just my opinion, but this country is really not hard enough on this type of violation.
