So three weeks after the man in the hat decided to destroy my 66 Mustang, I still do not have an offer from his employer's insurance company, other than them telling me they consider the car to be totaled. And we haven't even started discussing payment for the medical bills resulting from the huge gash on my forehead that had to be sewed up (lap belts, not surprisingly, are not the most effective safety mechanism!).

This. It's called subrogation and it's situations like this that it was created. Your insurance company wants to keep you, so they are going to be nicer to you. You'll have to pay your deductible, but they'll get things handled for you quickly and probably more fairly. Then they collect from that company or their insurance company which usually involves getting your deductible back as well.

they consider the car to be totalled but did you send them estimates? They dont want to play ball take it to a high end restoration shop get an estimate or three and send it to your insurance.

Only if they're not able to reclaim the amount that they pay out. They'll erase the claim once they've gotten the money from the other guy. I've done it twice in the last 4 years and neither time did I have a premium increase.

I have nothing more to add than Damn that sucks. Hopefully insurance will get sorted soon to lessen the blow of loosing such a lovely car. And to echo the comments of many of the above/below, well done for not at the very least pimp slapping the fool in the hat.

Anyhow, I'm surprised it's not universal. In both of my experiences recently, once rear ended by a city bus and once by a Saab with two major insurance companies (USAA, Geico) that's how it was carried out. I didn't dig through the policies to see if it was written in there, but they're standard policies from bulk providers. Learn something everyday.

I know this feel, albeit with a car that's special to me, but perhaps not this special. My accident from August still isn't resolved in full with other person's insurance company.
Get thee a lawyer? Seriously. Especially if you wanted to prove that the car's worth saving. Not my favorite option since lawyers take a chunk of the settlement, but perhaps it's worth it in your case. Sorry, dude.

Lawsuit. As much as I hate the current legal system, this is a case I justify. I've been there. They're not going to give you the same value on the car, you're going to have to get that elsewhere... A good attorney will get you enough to get two new ones. I have no pity for stupid people; I have to dodge morons every day.

I don't think it's totaled. The frame can be straightened (I know it doesn't have a frame per se, but the structure underneath serves as one and that can absolutely be pushed back or replaced by a competent shop) and the rest is replaceable as Mustang parts are plentiful these days. Get the highest values you can on the car (Barrett-Jackson) and sue the pants off that SOB. As the others have said, lawyer up. I bet you can get a pretty good pile of cash for emotional distress as well.
