More insurance shenanigans.

So I am still dealing with this ridiculous accident from mid October where I rear ended a person whom cut me off at highway speeds and then jacked on his brakes. He was later cited for reckless driving.

Fast forward to last week, I get an email that he has filed a claim against me.

Today, I finally got to speak with my insurance agent (we've been playing phone tag as I've been inundated with working SEMA). Apparently this guy told the insurance company that it was a low speed accident where I rear ended him and we exchanged insurance info as the damage was minimal (he's trying to get me to cover the cost of his bumper).

I then provided the NHP accident report number where not only my side and his are recorded, but the report of a third party witness backing me up, a copy of the citation he received for reckless driving and driving to endanger, and pictures of the incident.

I just have to wonder, what is this guy thinking? lying to the insurance company; did you think they wouldn't follow up? Once the report comes through my agent will call me with the decision, which will undoubtedly find him at fault.

From what you've said in your past posts, he may genuinely have some kind of mental disorder. I can understand maybe trying to convince the insurance company it was partially your fault, but filing a claim with all this information and evidence stacked up against him makes it seem like the dude isn't right in the head. Luckily all that information and evidence is available, I can't imagine what kind of shit you'd be in without that witness, especially with this jackass.

Wow that's awesome that you work at SEMA! Maybe they'll have some cool dash cams on display? (sorry, had to do it!)

I hope that tard gets arrested for insurance fraud! Usually if the other driver gets a ticket and you don't, then it's generally considered their fault.

And they might even go after him for the damages to your car (If you file under your collision coverage). Plus if you lie to any insurance company, it does come back to bite you.

If you have filed a claim against his insurance, I'd provide that information to your agent as well. Filing a claim while you have an at-fault claim open for the same incident? Let's just say that won't end well.

There is a good chance he might attract someone's attention...Filing a claim and "forgetting" a few facts (for instance, the accident report... ) isn't something that is easily dismissed.

Or forgotten by the insurance companies. I wouldn't find it surprising if they drop him, once the agent calls in the shenanigans he's trying to pull.

You never lie to three people: 1) Your lawyer, even if you are as guilty as sin. 2) Your Honor, in his courtroom. 3) Your Insurance Company.

He actually has the same insurance, and my agent said 'if' they do find him at full fault, they will get me a brand new bumper.

Now if only I could make this play into my favor and get a nice stubby winch mount bumper out of it.

Haha people are so dumb, but this reminds me of something I'm dealing with. Last November this dumb bitch pulled in front of me going into a shopping center and I slammed into the side of her car because I couldn't stop, I was on my road bike (bicycle). I got all her information, called out the local police even though I forgot they won't take a report, filed a claim with her insurance and that's when she proceeded to try and get out of it.

At the time of the incident she was apologetic, but when she sobered up she tried to lie her way out of it. But before she lied to the agent she avoided calling him back and I had to call her and remind her of my right to sue her ass off if she didn't corporate, she called him the next day =]

But she said I ran into her (which I did) while she was PARKED in the driveway. Nice try but blocking a driveway with oncoming traffic is prohibited in the CA Vehicle Code. The insurance ruled she was at fault, nice try bitch.

People will always try to lie their way out of a bad situation, and people are find lying to the insurance. Even if you didn't have a witness the fact that he was cited for reckless driving tells the insurance agent all he needs to know. The dumb ass will be found at fault, don't worry.
