Cop definately escalated the situation, and should have handled it differently. But still, loitering outside an ABC with an obviously spiked can of tea? Yes, you can be detained and questioned on reasonable suspicion of driving under the influence. Video is edited, so we're not sure what the cop said when he first approached, if he showed a badge, etc. We only see what the video editor wants, and deletes the rest.

LEO's are developing and continuing to develop protocols for handling "on camera" situations and need to be aware of the fact that their actions can be skewed by perception and need to respond accordingly.
