So here’s my understanding of what’s going on.

The EU requires operators of motor vehicles to carry insurance, and for that insurance to pay for others’ damages.

Someone got hit by a tractor and injured, and wanted compensation for their injuries. The tractor was actually insured , but the insurance company tried to get out of it by claiming that the insurance policy only applied on the road - in this case, the tractor was backing into a barn.

The EU determined that the regulation didn’t actually make that arrangement legal, and that the vehicle’s primary use needed to be covered by the insurer. Basically, they upheld the law as it is.

The problem is the implications here, and what all has to carry insurance. However, importantly, the EU didn’t set out to ban motorsport. The courts have to rule on the laws as they are, but the legislatures are well aware that there’s huge problems with the laws as they are, and are trying to fix them.

It’s not going to affect those who do stage rallies as they are already insured (Inc tax and MOT) the ones it’s going to affect is people who compete in events such as autocross (what Americans call rallycross) and auto tests as those types of events the cars are trailered to the event as they typically wouldn’t ever see public roads so most owners would forgo the extra expense of insuring/mot/taxing them

It’s more likely to require off road events to have the same level of cover as on road events- either with competitors own specialist insurance, or through the PAYG idea.

For the Road rallies we pay £15 a day. Standard motor insurance excludes competitive use- this is from my most recent policy

“This policy does not cover use on the Nurburgring Nordschleife, racing, competitions, speed testing, rallies, track days, 4x4 off road events or trials, any purpose in connection with the motor trade, hiring or carrying of passengers for profit”

For something like an autotest where some of the cars aren’t road legal it may be that the organiser may need a blanket public liability insurance covering the whole event.

We’ll see what happens, but as is often the case with this kind of thing there may be some overreaction (Especially as it’s the EU involved...)

The bigger issue is that the way the proposed law is written any motor racing accident would require the same investigation and police involvement as a road incident. Car bumps a tire barrier? Stop the event and get the police out on track.

I think we already require the basic level motor vehicle insurance for most motorsport events in Finland for cars (I don’t know about motorcycles but probably same thing with these). It’s pretty much the same insurance that normal road going cars are required to have so it’s not very expensive. I can’t see how similar requirement would end motorsports in UK.

My track day Vectra has a special insurance that also covers the damages to the car itself while participating in motorsport events. The basic level motor vehicle insurance will only cover the damages to the “other party” and to the driver.
