I must say, I do appreciate it when people use it for curbside loading/unloading because it improves visibility and indicates some degree of situational awareness. Using it to park wherever you want though, fuck off.

You can always park anywhere you want, you just have to usually pay a premium parking fee. Sometimes you even get VIP vehicle relocation to a nearby lot for an extra premium fee. Just like you can drive at any speed on the highway for a premium driving fee. Unless of course you are in Virginia, then it involves staying in a premium overnight facility and the food kind of sucks there.

I’m pretty sure the driver of the car that hits him is still liable. If the driver in front of you stops in the road and you hit them, you’re still liable. It’s your responsibility to leave enough space that you can safely stop if there’s an obstacle.

They’re still liable, but by how much? A dumb shit with their park anywhere lights on is way different then someone rear ending you because they weren’t paying attention. In that situation the person in the back is almost always 100% responsible. But if the person with their park anywhere lights is right around the corner in the middle of the street, I’d argue they’re more than 50% liable because you can’t legally park there.

But also you shouldn’t be blindly ripping around corners at speeds where you can’t stop if there was backed-up traffic, a j-walker, a broken-down car being pushed out of the road, etc. If you drive your car into a stationary object you still drove your car into it, and one with flashing lights on it is hard to argue it wasn’t easily identifiable as an obstacle. If there isn’t a legit reason for the car being there, whoever left it there will likely get a ticket for obstructing traffic, but if you were driving in such a manner that you couldn’t safely avoid a stationary car-sized object with warning lights identifying it as an obstacle, you’ll be lucky to avoid a reckless driving charge. The driver is responsible for not hitting things, and if the driver drives around the corner without accounting for the potential for perfectly legitimate obstacles, they’re driving without due care and attention, and it’s their fault if they hit anything.

You’re right in that you’ll have a tough time getting your insurance to cover damage that occurred while it was being operated illegally, but in a police report, it’ll still the be the driver’s fault for hitting an immobile object. The driver’s insurance will treat it just as if they’d hit a light post or a tree.

I can tell you from experience (not my own, but from knowing law enforcement) that in certain circumstances the parked car will be at fault. This is contingent on the corner, the speed of the driver, time of day/weather conditions.

But from what I know about traffic law, and now tort and negligence theory, if you park your car around a blind curve and someone doing the speed limit comes around it and hits you, the parked car will be liable.

Of course, you can say people shouldn’t be tearing around the corner, but if the speed limit is 25 and you can’t see around it, you can’t be held at fault. The person illegally parking their car has a duty to everyone else on the road to not create a hazard.

You can’t expect people to assume there is going to be something in the road. All you can expect people is to do the speed limit which has been set (supposedly) to allow you to react to reasonable objects. That’s why if you hit someone who’s just darted out into the road you won’t be held liable. The person breaking the law will.
