Hot take on the Texas church massacre

The worst mass shooting in Texas history appears to have stemmed from a “domestic situation” between the shooter and his mother-in-law, who attended First Baptist in Sutherland Springs.

Thank god it wasn’t terrorism!

There’s a question on if the Air Force forwarded the UCMJ domestic violence conviction to the FBI’s criminal records database. I guess that’s not automatic?

Hey, I’ll have you know that sometime the USAF is efficient, like stetting all the launch codes to 0000000. Much quicker than pressing multiple keys.

No. I said that in somebody else’s post.

I see a lot of outrage™ on here, Facebook, and elsewhere about a lack of progress.

Guess what. What’s in place is not working as intended since the database sucks. We can start just by fixing that and we don’t even have to fight for/against new laws.

He was given a “bad conduct discharge,” not a “dishonorable discharge.” A dishonorable is more severe and would have meant he could no longer own or purchase firearms. The bad conduct, not so much.

Though... I’m hearing the DV nature of the charges should have... maybe(?) meant he shouldn’t have been able to have weapons.

The DV nature of the conviction would bar someone from passing a background check (if the conviction was included in the database)

Last night, the TX governor told us go home and hug our kids. Good advice, since they may be dead by tomorrow, since nobody shows any interest in trying to do anything about it.

Also, the majority of mass shootings in this country are perpetrated by white men with a history of domestic violence.

But, of course, let’s not talk about that, either. Now is not the time to “politicize” this.

We really just don’t know why these things keep happening.

Over and over and over again.

To the exclusion of every other first world nation.

In this country which makes up only 5 percent of the world’s population, but whose citizens own nearly half   (47 percent)   of the world’s guns.

How is it that all the outrage is funneled into the desire for stricter gun control, yet we barely enforce the gun control laws we have?! This is also a place where military law fucks up. How does this guy have a history of violence, yet still owns firearms? Most likely because his UCMJ violations were kept in-house.

Sorry if it’s not readable, but this is straight from the ATF 4473 form. 11.i should have been a disqualifier. It sure looks like the database was not updated with his conviction.

Yeah. I imagine we’ll understand more in the coming days, as the investigation continues. But I know that, initially, when reports were asserting he had been given a dishonorable discharge, people were asking how he could have legally had guns in that case.

Maybe, as was the case with that (where it turned out to be a non-disqualifying “bad conduct discharge”) the level of crime wasn’t “severe” enough, for lack of a better word, to bar him from gun ownership. I don’t know what the actual charges were (I realize I should just google that).

Anyway... even if he was, indeed, barred from owning/buying a firearm, and would have failed a background check, there’s still a gun-buying loophole: a person to person sale.

You have an AR-15. Bob wants buy it. You’re not a gun dealer. But you don’t have to be to sell your own personal property. You think Bob looks like a nice enough person. He’s well-dressed, clean cut, polite. You fill out this form , Bob hands you a few hundred bucks, and bam! he’s got a gun he shouldn’t be able to have.

That’s my main gripe. People are yelling for more and more gun control but what we have already appears to have some serious holes.

If I remember correctly, Dylann Roof got his hands on a gun due to a technicality- he would have been a prohibited person however there’s a law in place that defaults a firearms purchase to “OK” if the FBI drags ass for more than 90 days. They did not get their shit together so off he went.

As I just commented to For Sweden...

Even if the database had been properly updated, Mass Murdering Fuckface still could have legally purchased a weapon through a person-to-person loophole.

If you are a private citizen who owns a gun and Bob sees your ad on Craigslist, all you gotta do is fill out a piece of paper transferring ownership to Bob. You walk away with a few bucks, he walks away with a gun he shouldn’t have.

I would argue that we know exactly why it is happening. It is a combination of mental illness and the easy access to semiautomatic weapons. Every country in the world has their share of crazies. But everybody else’s crazies can’t go out and easily obtain an AR-15, let alone a bump stock. As long as these events continue, with no action of any kind from our political leaders, either through enforcing existing laws or restricting access to certain types of weapons, people will see mass murder as an effective means of carrying out their personal grudges.

It’s possible to bypass, but CL doesn’t allow gun sales. Many states are also now requiring a FFL transfer of person to person sales, which includes a background check. I agree this should be universal.

Yeah, I realized that after I posted it. Lol. I was like... wait... Facebook doesn’t allow that in their Marketplace... so why would CL?

But, regardless... person to person sales happen ALLLLL the time, especially in Texas. And it’s not difficult to find a gun show going on somewhere near you on the weekends. Lots of people just go out to the parking lot and sell there.

The shooter was also given a dishonorable discharge from the military, which means that legally he wasn’t permitted to posses a firearm.

Clearly there is an answer to keep future individuals that aren’t permitted to legally posses firearms from possessing firearms:

here in canada,

We must take a firearms safety course, then get a PAL (Possession and Acquisition Licence) that we must have as long as we have a firearm. This is handled by the RCMP and is valid for 5 years.

you need this licence just to buy ammo too.

It is a Privilege not a right just like a license to drive.

It’s true, yes, but that’s not what happened here... He was denied a CHL by the state of Texas because of his inability to pass a state background check, however the feds dropped the ball when he went to purchase the firearm from a FFL and passed the federal background check.

The laws we have aren’t working. The answer isn’t more laws that won’t be enforced.

Mexico’s got plenty of mass shooters. In the U.S.A. it’s a popular leisure-time hobby but in Mexico it’s a career.

Of course their politicians might play that! “Gringos, coming down here and stealing out jobs!”

a lot of people don’t get that the people in Mexico (northern Mexico primarily) that are getting killed are almost always within the cartels only. Tourists and people not associated in that stuff are never victims hardly ever. In the US, it seems to just be random people

Here’s a fun fact. Australia’s public service broadcaster has a small posse of Oz correspondents based in the US. They don’t bother phoning in US mass shootings unless there’s at least ten dead. They are too frequent and no longer considered newsworthy.

Even this past weekend’s effort got bumped down the news feed by a report on tax evasion (Paradise Papers).

I’m not 100% on this, but a BCD granted due to a domestic violence charge, especially with prison time, should absolutely have barred him from *legally* purchasing a firearm from a FFL.

Sadly, this is just another case where some pathetic, do-nothing nonner in the Air Force shrugged off their job with no consequences.

Except this wasn’t a one-off. The military has admitted it has a larger scale problem with not reporting names to the NICS.

And again, even if everything HAD gone the way it was supposed to, Maggot-eating Mass Murderer von Fuckface still could have purchased a firearm from the handy dandy private seller loophole.

Kinja'd!!! "Tristan" (casselts)
11/06/2017 at 23:45, STARS: 0

Totally agree, and I’m certain it’s not a one-off. I have a lot of angst built up for the side of the military that gets to do a half-assed job and get away with it. I’m on the side of it where mistakes either ruin a career or get people killed, yet the flunkies in finance or personnel get to conveniently lose your paperwork, give you 5 different answers to the same question, act surly and inconvenienced when asked to do their jobs, start at 0900 because they’re doing unit PT (usually frisbee) and close up at 1300 for “training”.

And even if guns are outlawed completely, Maggot-eating Mass Murderer von Fuckface could still mass murder in other creative ways, including getting ahold of an illegal firearm. The idea is to make it more difficult for him to get ahold of a gun.

All firearm purchases should be required to take place at an FFL, and should accompany a background check, though. And full disclosure: I’ve purchased a firearm from a stranger in a parking lot. It seemed shady as fuck, and the whole time I thought “this shouldn’t be legal”.

he got the Big Chicken Dinner, not the DD. anywho, the whole pleading guilty in a domestic violence court martial which the Air Force failed to report should’ve flagged him in a background check, but then again background checks still aren’t required in transactions with private party sellers.
