How does that work out? Is the car usually insured under the Dealership insurance? Is it on you?

Let’s say you found a lovely 2017 Scheiß-Braun Audi Q7 TDi to replace your aging white 2009 Q7 V12 S-Line and the salesperson wanted to sell that car so much they suggested you take it home for the weekend.

So you, as an Audi driver, decide to take the almost-yours 2017 Q7 to your lovely daughter Kayakina’s organic badminton practice.

On the way there, 98 year old Jedediah Old Republican Man rear-ends you with his 2002 Chevy Silverado because he was distracted with Jesus radio.

Jedediah dies because he don’t believe in no God damn healthcare. He waited for Jesus to save him, but Jesus wasn’t there.

So now you have to call Big Billy’s Audi, Guns and Golf Club store and face Social-Anxiety, their sales manager.

How do things play out with the dealership?

It’s fair to say your insurance would not cover damages to a car that wasn’t yours/ on your policy if you were driving it.

If someone else is responsible for the wreck, their insurance is primary, yours is secondary, and the dealership’s is tertiary.

If you cause the wreck, your insurance is primary, the dealership’s is secondary.

My insurance applies whenever I drive anyone else’s car. It’s why I always decline additional insurance at the rental counter.

As I understand it, I only have to add a vehicle to my insurance policy if I am a primary/regular driver of the vehicle (however that is determined).

That’s not necessarily true, and it varies by state. Typically, auto insurance follows the auto, not the driver (but again, it can vary by state).

I have found a fundamental difference is how Insurance works in Brazil and North America.

I guess insurance in the US is a lot more comprehensive.

Check with your agent. Your policy may not cover a car that you rent. Mine doesn’t, so I have to get the rental insurance.

However, my insurance does cover a car I borrow, including test drives from a dealership.

Good point, I think this was the default rule but isn’t always true. And more insurers are moving away from this.

Last time I checked with my insurer (USAA) they said they do cover rentals in the US.

I got caught between Enterprise and American Express when someone backed into my rental in a parking garage. My business AMEX provides rental coverage when it’s used for business purposes. Enterprise wanted to charge for lost use. AMEX wanted them to prove the loss of use. Back and forth they went until Enterprise decided to come after me instead.

It took over a year and the involvement of our corporate lawyers before it was settled. Who won? I have no idea.

Last year I was offered an extended test drive on a new BMW 328 the day before I was leaving town for a road trip with my wife. I went through all of the process to do it before I decided that the shock value of appearing at home with a new car unexpectedly was not worth the logistical challenge of returning it before I left town. Dealer suggested I take it on the trip but I said no because of concern about damage from rough roads and I was pretty sure I wasn’t going to buy it at the price they wanted.

The dealer required a copy of my insurance card and explained that the extended test drive was essentially a no-cost rental agreement. So, as long as my insurance covered rentals (which it does), then my insurance would cover any damages to the extended test drive vehicle.
