Undercharge for cleaning and repair, don’t include in deductions items that I am covering out of pocket, work hard to get the most refund on deposit as I can (and WAY more than fair) and as fast as I can so they can apply it to their new rent...and I get threatened with small claims court. Good times.

Did I mention that he was out of the place a day after contract and 30 days late on his last rent and that I didn’t and never collected late fees on rent (which was nearly every month)?

Screw renters forever. My 2 cents is that nothing will come of it, but if it does...and I hope for his sake that it doesn’t...its not going to go well for him, I have him on video during delivery accepting the place as clean and clearly showing a much cleaner place than they left me. Cmon man, do the smart thing and suck it up.

Seems unlikely that he’ll follow through - probably an empty threat to get what he wants (and pay the new landlord...).

Glad you’re rid of him. Small claims court might actually be fun, to embarrass him...

California being the liberal state we are it is very pro renter, and I can literally go around punching holes in the wall and no repair them and get my full deposit back. Holes in the wall up to the size of a fist are considered reasonable wear and tear.

You can basically walk out with the house dirty and gross and get your deposit back. But I think you can get around it with a separate deposit for cleaning, but I’d be able to get that back if I cleaned the house. Normal wear and tear (the holes) wouldn’t count either.

I would never want to be a landlord in CA because I’ve never met a renter like myself who actually gives a shit about the house they’re in and treat with any ounce of respect. I don’t get how renters live in a pig pen the whole time.

Fun fact: apparently my house is the only one my management company has ever seen so clean, and she can tell it’s always clean;

“I can tell when a tennant cleans just for an inspection, and when it’s actually always clean.”

In Utah you aren’t required to give anything back, and it doesn’t stipulate what wear and tear is but its generally considered that stained carpets and damaged walls aren’t wear and tear. Hopefully he’s just shouting into the dark. You never know with some people. He’s not the first to threaten to sue over a deposit either.

Im waiting to see if he follows through. I think he will be in for a shock when he finds out I can still sue for late fees if I choose.

Agreed. I would consider commercial property, because the laws for that are very different. Residential property, no way.

Personally I would consider small stains here and there normal wear and tear, but not murder scenes, which is what I’m sure is usually left. I also don’t find fist sized holes normal wear and tear, but normal nails, yes. I imagine it was written broadly as to dissuade asshole landlords from trying to keep a deposit due to a holes from nails.

He probably is, because I highly doubt his deposit is going to me than what a lawyer would cost to even write you a “threatening” letter.

I find there is a direct relationship between how much you need the money back and how much you expect. Often times this is inverse of reality.

I got my full deposit back on every place I ever rented. I also left each of those places better than when I moved in.

The one time a small hole in the wall did happen, a trip to Home Despot for a small piece of dry wall, some mud, tape, spackle and a sample-sized container of matched paint solved that problem. I never told, and they never noticed, and probably because the repair was pretty indistinguishable from the rest of the wall if you didn’t know exactly where it was.

I also had no problems getting deposits back. Mostly for the same reason. We generally improved any place we occupied. I mean I always rented a carpet cleaner to make sure. It’s not hard.

I don’t know what small claims court is like in your county, but I worked in landlord/tenant law and dispute resolution for years (probably saw over 300 cases), and in my experience your video might not count for much.

If your court system is severely overstretched (like most around the country), the judge will likely take one look at any of these possible suits and send you straight to mediation, where they can’t technically cosider “evidence” in the legal sense.

I’m a big fan of mediation in general (saves boat-load of time, stress, and energy if the mediators are good), but it can be very frustrating for one party when they are clearly in the right.
