Come on guys, if you’re gonna do a full piece on the subject, learn the terms! By doing stuff like this, you litteraly make MY JOB sound illegal when it’s not.

Grey market imports are legally imported vehicles that were brought in the country by private parties or companies that aren’t the manufacturers of said vehicles.

Black market imports are illegally imported vehicles brought into the country by private parties or companies.

Not hard to figure it out BEFORE the article...

I don’t know his work much so I can’t say, but so many things are wrong in this article... Worst being that Supra seller who sells a 1993 car “that won’t be registrable until next year”... IT’S AN ILLEGALLY IMPORTED CAR! IT WILL ALWAYS BE ILLEGAL GODDAMN IT!!

On top of that, the writer did a very poor job of explaining “Show & Display.” From that piece, it sounds like anyone can import and register whatever car they want, as long as they say it’s a show car and don’t drive it a lot.

Really quite a pity that a car that becomes of legal importing age still cannot be registered if it wasn’t properly imported. There should be a system in place for this. Like maybe pay to have an inspection done to clear the car for registration.

Close. Grey market is when the legally imported car (or other item) was never intended for sale in the country to which it is imported. For instance, an imported Skyline would be grey market because the product was never intended to enter the U.S. market due to different specs/requirements/etc. whereas a special-order BMW or Porsche that the owner picked up at the factory in Germany and then shipped to the US on their own dime would NOT be grey market because it is the same spec as is sold domestically.

By way of example, though it’s not related to cars, there’s an actual trademark case where a manufacturer of face cream had their U.S. affiliate sue their U.K. affiliate because the latter allowed the product to be bought by a wholesaler for sale in the U.S. The basis for the suit was the difference in chemical formulation for each market. Without going into detail, the U.S. affiliate lost because the product was produced legally, sold legally, and imported legally even though it was never intended for sale in the U.S. That’s grey market.

Sure it can. State registrations get issued for illegally imported cars all the time, regardless of their age.

Whether or not the car has a state registration/title makes no difference in the car being illegal on the federal level. After the illegal car reaches 25 years, it might be acceptable to export it, and then re-import it (only this time legally)-- assuming of course the feds don’t crush it before you can get it out of the country.

Well, again, this is where the part that you didn’t quote comes into play... Some mechanism that doesn’t require you to export the car and re-import it.

The problem in the eye’s of the feds is that the car came here illegally (at the time it was imported). To them, it is ALWAYS illegal because it was smuggled, and I doubt they are going to allow anyone to benefit from the car being here now if it was previously imported contrary to the law.

Yes, bringing in USDM cars on your own is fine. This is why you can buy a brand new Mustang in Canada and import it in the US. You wouldn’t be able to buy a UK Mustang (now RHD) and ship it back though as such car will be deemed too different.

But the term grey market import was coined at the time Mercedes USA did its lobbying to instore the 25 year rule, when people who buy Mercs in GErmany and ship them back the US as it was cheaper than buying from Merc USA... Euro and US Spec cars were then made different and in 99% of the case aren’t importable in the US... This is not the case for Porsche (Euro spec and USDM cars are the same), but very much the case for Mercedes for example who made sure “their law” worked.

Yeah, you’re right. Your original post just didn’t distinguish between cars that were US spec and bought overseas and cars that were not US spec. I just wanted to clarify the terms for those reading.

US Spec bought overseas and imported at anytime = “white” market;

Non-US spec bought overseas and imported AFTER 25 years = “grey” market;

Non-US spec bought overseas and imported BEFORE 25 years = “black” market.

Although close, it ain’t necessarily the manufacturers of said vehicles that import the cars them selves to make it un-grey. There’s plenty of official importers that have nothing to do with the manufacturer other than the fact they have the official license to do so. These are getting rare (especially for big carmakers) but still. Louwman is the official Toyota importer for the Netherlands and is still mainly owned by Evert Louwman.

I’m a grey importer. Not just due to my hair.

Of course, but I include “companies who have an agreement with the manufacturers” in the list of non-grey importers. My point was that if you have anything to do with the manufacturer and officially work hand in hand with it —> “white” market
