So somehow I was able to purchase my house without a property functioning and definitely not a properly inspected septic system. While I am waiting for the final report to be written up by the guy who just finished testing my system, I have been looking into who was responsible for this. The first guy who most likely could have been found liable for this was the guy who did the inspection hired by the foreclosure bank at the time I purchased the property. He was a 1-man office and he is dead. I did not kill him, it happened before I knew there was a problem. There was a good chance the realtor, who was a nightmare to deal with could have had part in it. He is also dead, natural causes. Next I’m going to look into who was involved from the town and health department. I have also been told my closing attorney should never have allowed this to pass and could be liable as well. I had no problem going after the inspector as it was him intentionally not doing what was supposed to be done, however I don’t know if i’d go after the attorney, who made a mistake. This could potentially set me back up to $20k or a used WRX. (more likely the addition I was hoping to put on the new house)

It would probably have to end up with the deceased inspector since he was the one to sign off on everything having to do with the septic system. He should have had insurance which I would expect would cover this... but I’m no attorney.

yea, i havnt really gotten too far into this, but with him working as a 1 man office, and I believe nothing that continues to operate, I think he is a dead end.

Seems like it would be on the inspector. Still, I wouldn’t trust an inspector hired by another party.

that is typically who hires them. I hired the guy inspecting the house i’m selling, same with the people selling the house i’m buying.

well there is a house inspection, and then what i’m doing which is Title V for septic.

Not in my experience? While it would be more efficient to just have the seller do an inspection which can be shared with any potential buyers, it’s the buyer who ends up in a bad situation if the inspection misses anything. The seller’s incentives hiring someone are just to get it done quickly, cheaply, and to have it turn up as little as professional responsibility will allow. If you really want to know what you are getting with your very expensive purchase you hire your own guy (even if the seller has done an inspection). The guy you hire may still suck, but at least you have a bit more control over process, and get someone whose interests are a bit more aligned with yours.

I don’t really see why a dumpster fire is that big of a deal. It consolidates the waste and saves more room in the dumpster. Think of the savings of continual dumpster fires! Nevermind the thick black smoke into the environment.

I would think you’d want to hire your own inspector to protect your interests. That’s how we do here in mi.

i’ve never heard of anyone hiring their own Title V inspector. Maybe the difference for this is that there is the inspector and a soil engineer, from independent places, along with submitting the findings to the town and board of health for approval.

Hopefully the (dead) inspector was a real business with business insurance. Which may cover your loss, although it depends on a lot of facts.

I would assume the original inspector was bonded and that said bond would be required to not expire for some period of time after his death.

That said, I’m not a lawyer.

You need to tie up that inspector’s estate if it’s not been probated.

Sold a house in the 90s where they told me the current septic system was illegal. I had the best man in the county trying to get it to perk ... took 3 tries. Eight grand later there was a new one. And don’t get me started about the well ....
