My client has $2.4 million of exposure, and after 6 hours of mediation, I had a tentative deal to settle for $1.25 million - more than half of my client’s net worth. I drove 6.5 hours round trip, partially in driving rain, to tell my client they were fucked and we had to take the best deal we could.
We had no leverage because the previous lawyer made a mistake that waived our defenses.
I had to stop my client from throwing his 45 year union pin at the representatives for the pension.
This was one of the worst days I have had as a lawyer, so I am having dinner and a beer.

If I had 1.25mil that someone could take from me with another million to spare, I wouldn’t be hiring a lawyer to try and keep it. I would just take my money somewhere where the courts couldn’t touch me. How do suckers manage to get so much wealth?

Well, that sucks. My day was kinda crappy too. I’m searching for my mom’s missing safety deposit box which I know contains important paperwork, but the bank she told me it was at has no record of it. Now that I’m on the hunt, her accounts are getting shut down as I make each bank contact, so I have to deal with her bills out-of-pocket until we can get her accounts released which requires me to file a bunch of paperwork. I’m glad I paid the electric bill! I can continue to clean out her house with the a/c on.

It sounds like you got a good result considering the situation. I had a client go rogue on me last week and do something I strongly advised against, this week I’m just waiting for the fallout.

Am sure this is already taken care of, but it never hurts to ask. Has the client put the prior lawyer and, more importantly, the malpractice insurer on notice? Not sure about California law, but the other carrier may need to have an opportunity to participate in the settlement discussions. And it might avoid a subsequent argument that they could have done better.
