Such is life for FP authors. On one hand you have Tavarish, who towed a heavy U-haul trailer half-way across the country using an accessory hitch with an adapter...A tow rig that could have easily failed in deadly fashion.
On the other hand you have authors driving projects that clearly aren’t street legal or even relatively safe. Why can’t this thing go over 40 again? Also, if it can’t exceed 40, then it’s technically not even legal to drive on highway roads in some (most?) states.

That depends greatly on the state, though. Ohio, where I am, has this:

(A) No person shall stop or operate a vehicle, trackless trolley, or street car at such an unreasonably slow speed as to impede or block the normal and reasonable movement of traffic, except when stopping or reduced speed is necessary for safe operation or to comply with law.
(B) Whenever the director of transportation or local authorities determine on the basis of an engineering and traffic investigation that slow speeds on any part of a controlled-access highway, expressway, or freeway consistently impede the normal and reasonable movement of traffic, the director or such local authority may declare a minimum speed limit below which no person shall operate a motor vehicle, trackless trolley, or street car except when necessary for safe operation or in compliance with law. No minimum speed limit established hereunder shall be less than thirty miles per hour, greater than fifty miles per hour, nor effective until the provisions of section 4511.21 of the Revised Code, relating to appropriate signs, have been fulfilled and local authorities have obtained the approval of the director.
(C) In a case involving a violation of this section, the trier of fact, in determining whether the vehicle was being operated at an unreasonably slow speed, shall consider the capabilities of the vehicle and its operator.
(D) Except as otherwise provided in this division, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
Effective Date: 01-01-2004; 09-21-2006 .
The tl;dr is, if there’s no posted minimum, and you’re going at your vehicle’s top speed, you’re fine in Ohio. And, the highest posted minimum that’s legal in Ohio is 50 (which this can’t do, though).
Edit: I did forget, though, that there are a couple exceptions to the above law.
FMVSS 500 Low Speed Vehicles (at 25 mph top speed by law, more commonly known as Neighborhood Electric Vehicles, but the law doesn’t actually require them to be electric) are forbidden from any road with a speed limit greater than 35 mph.
Under-speed vehicles (20 mph top speed by law), utility vehicles (think John Deere Gator), and mini-trucks (kei trucks) are forbidden from any road with a speed limit greater than 35 mph, and the locality responsible for the road must also permit them to be used.
Motor-driven cycles/motor scooters (50-150 cc, under 5 bhp, seat for driver and floor pad under feet, no more than 3 wheels) are forbidden from any road with a speed limit greater than 45 mph.
Anything with under 5 bhp is forbidden from freeways.

I’ve also edited my post to include some exceptions. (Basically, they boil down to NEVs, 50-150 cc under 5 bhp scooters, golf carts, side-by-sides like the John Deere Gator, kei trucks, and anything under 5 bhp.)
And, my guess is that the Jeep doesn’t have enough power to go much over 40. The Go Devil was rated at 60 hp, and his probably has quite a bit less... and terrible aerodynamics hurt the speed even more. And, who knows, maybe it’s valve floating due to high RPM, because the gearing’s optimized for crawling, not 2017 freeways.
