Kinja'd!!!

1. Company receives two separate, unrelated reports of workers smoking weed at an outdoor picnic table at the work site.

2. Two witnesses, one an employee and one a family member picking up an employee from work give statements confirming by smell and appearance that it was definitely weed. Another witness says one of the smokers (from a temp agency) bragged about how the agency let him get high at work.

3. The company investigates whether the supervisor in charge of the area knew or should have known.

4. The male supervisor claims that one of his female subordinates sexually harassed him. She denies it. She is a custodian, lowest position in the company. He claims that he went to HR, and HR refused to help. He never sends an email or documents in any way. He never writes her up for inappropriate comments or behavior, despite having authority to do so.

5. He is fired because he either allowed the weed smoking, or wasn’t paying attention. Very hazardous workplace.

6. He sues, claiming harassment and retaliation for reporting harassment.

As the safety director for my company, anytime an employee creates an unsafe work environment he/she has to be at least suspended. I would need to re-train the employee to my satisfaction, and if that were unsuccesful then they would be fired. I am a nice guy though, other people would not be giving second chance.

I say documentation is critical. Just one email, even to a coworker or friend referencing uncomfortable interactions would make the difference. He’s got nothing. If his lawyer is ballsy enough, and the employer is risk averse enough, maybe he’ll get a settlement to go away. Long shot in my unlawyerly opinion.

It seems pretty shaky. While I suppose it can happen, sexual harassment of a male superior by a female subordinate is extremely rare, I’d say maybe 5% of cases or less. Taken in with the other circumstances, and him only reporting it when he was being called onto the carpet for an offense of his, I wouldn’t be predisposed to believe him unless he had some pretty damn good evidence.

The fired male employee can GTFAC. Weed is legal in CA if you accuse anyone of smoking on the job they will probably blame it on second hand smoke. Unless he has documented the harassment it is just a he said-she said situation.

If the glove doesn’t fit  you must acquit.

On the one hand, I’d be slightly more willing to believe him on the sexual harassment and the lack of reporting it beforehand because:

1. Men are way less likely to report incidents of sexual harassment because they fear not being believed or being ridiculed for not “being able to handle one chick who was hitting on you.”

2. Men are less likely to be the victims of sexual harassment to begin with, especially by women who are subordinate to them.

In all the instances of workplace sexual harassment I’ve ever experienced (sad that it’s more than once. Even sadder that the same is true for most other women, too.) there was only ONE time where the dude was subordinate to me.

HOWEVER, he completely negates all that benefit of the doubt, in my mind, by blaming the lowest person on the totem pole only AFTER he was facing disciplinary action for something completely different. To me, it smacks of him thinking “what can I come up with that’s WAAAAY worse than pot that’ll maybe get me outta this?”

It sucks, but the only way to definitively rule out his allegations is to investigate this woman he’s claiming harassed him. If she really did, he probably wasn’t the only one. Sexual harassers — of ANY gender — rarely limit their shittiness to a single occasion or a single person. Because it’s not actually about sex. It’s about power. So, if she really did it, likely there will be others who experienced the same from her, or whom she made feel uncomfortable.

But my guess is? This asshole is trying to save himself and ruining her reputation in the process.

He claims that he went to HR, and HR refused to help. 

I assume that HR denies he ever raised the issue? If he has no documentation of any kind and HR denies it, he should be fired for multiple reasons (not knowing about the weed smoking, lying, general assholeishness, stupidity, etc.).
