Here’s the crux of the Republican argument for those who can’t be bothered to do a little digging:
Sen. Charles Grassley (R-Iowa) spearheaded the repeal effort and said the regulation unfairly stigmatizes the disabled and infringes on their constitutional right to bear arms. He said that the mental disorders covered through the regulation are filled with “vague characteristics that do not fit into the federal mentally defective standard” prohibiting someone from buying or owning a gun.
Grassley cited eating and sleep disorders as examples of illnesses that could allow a beneficiary to be reported to the background check system if they also have a third party to manage their benefits.
“If a specific individual is likely to be violent due to the nature of their mental illness, then the government should have to prove it,” Grassley said.
I don’t disagree with the argument that persons with potentially violent mental/emotional disabilities should be restricted from purchasing firearms, but if the government wants to move forward on that, they better have some damn good criteria in place.

I feel like you didn’t read the article. Even the ACLU was opposed to this regulation. It unfairly cast a wide net with very generic labels for “mentally impaired”. Do we need better regulation? Yes. Should we trample other peoples rights in order to catch a few who might cause harm? No. That’s exactly what the US should be fighting against. Usually it’s the Republicans creating laws that disenfranchise a large group of people to target a few within that group. Don’t be a hypocrite now that the Republicans are blocking a Democrat regulation that did just that.

The intent behind the law, if I’m not mistaken, is to keep guns out of the hands of dangerous people due to a mental illness.
But if the mental illness doesn’t make them a danger to others, they should be able to own a gun.
Unfortunately, the public mental health system is in tatters and current background checks aren’t stringent enough to tell apart anorexia from an arson fetish disorder (or something dangerous?), we’re fucked.
The real problem is the state of the public mental health system and unwillingness of Republicans to mandate strict background checks.
There’s only 2 ways about this without making significant changes to a system that benifits powerful people in its current form. Either block access to all people with mental disorders. Or let all people buy guns freely, even ones that have mental disorders.

I’m torn on this one. I completely agree with the spirit of this legislation. The mentally ill with violent tendencies should not own firearms. But the system that they were using to identify them is broken. Too many people with too many other issues would be lumped into this, and this does violate their 2nd amendment rights.

That’s not what is being argued here, what is being argued is that a person is automatically found to be mentally incompetent because they have a representative payee to manage their money from SS.
You can not buy a firearm if you have been deemed mentally incompetent
(I feel the need to bold this because for some reason people think that mentally infirm can now buy guys when they couldn’t previously), however you have a right to due process and to defend yourself against allegations saying as much. This law bypassed all of that and violated the 4th amendment.

It’s not anyone with a mental impairment, it’s anyone with a mental impairment that has a third party manage their benefits.

Per the National Alliance on Mental Illness, 1 in 25 US adults (approx 10 million) experiences a serious mental illness in a given year that substantially interferes with or limits one or more major life activities. The law being addressed only affected 75,000, or 0.75% of those that experience a serious mental illness.
Seems like we had some pretty good criteria (less than 1% of those with mental illnesses were affected), especially given that there’s still an appeal mechanic in place for those affected to display/prove that they’re capable/responsible enough to own a firearm.
I like guns. Guns are fun to shoot. I just think that we need a more stringent criteria than “you’re over 18, have a pulse, and haven’t been convicted of a felony”.
Footnote: Got sidetracked mid-post actually working for a few minutes, someone else already may have touched on some of these points in the interim, apologies for redundant information if someone has already replied in kind.

Ask Chicago about gun control too. Since you aren’t from the US I assume you are not intimately familiar with our firearms laws or process, that being said I don’t give a whole lot of weight to your opinion on the subject.
The reality is the people in the US clamoring for more gun control typically don’t have a clue what they are talking about. The vast majority of gun deaths are suicide, the vast majority of murders are in states with large amounts of gun control and committed with handguns. And by an incredibly large margin, most gun owners will never shoot anyone.
Oh, and the Assault Weapons Ban was incredibly stupid and should never be reenacted.

It’s not perfect, but it’s not a black and white area, either. I don’t know what the right answer is, but it seemed like a fair start. They weren’t casting a net over anyone with mental disabilities, it was only those that required assistance managing their funds, which seems like a halfway decent benchmark for ability to responsibly own and maintain a firearm.
The last time I purchased a handgun (2007/2008), it took about 30 minutes, start to finish. I was handed a clipboard, filled out some paperwork, browsed and meandered while my application was reviewed, and I was on my way out the door with a pistol and a few hundred rounds.
I received more scrutiny my last two trips to vote.

The problem neither side seems to want to fix is getting the NICD properly funded and have all the states properly report people who committed crimes in their states to the database, I think right now mosts states only report 80% of their felony convictions which is terrifying.
You fix that and all of a sudden a ton of people who shouldn’t be able to buy a firearm won’t be able to do it legally.

You want the real solution? Life sentences with no parole for people who illegally sell firearms, life with no parole for multiple time offenders for gun violence. Death sentence for murder. Enforce the current regulations.
At no point will you ever be able to stop someone that is willing to plan and set on harming people. I was so glad when I left that my new state would have reasonable gun laws, although the influx of people from elsewhere has resulted in new laws that are pretty annoying. We already policed ourselves surprisingly well in this state (for all intents and purposes, our state CCL was a perfect proxy for a background check and everyone demanded them before private party sales)...

I’m all for people not having guns. There are tazers, pepper spray, mace, home alone style booby traps. Lot of ways people can defend themselves. So if someone doesn’t gave guns, I wouldn’t mind that in the least.
But no matter which way the law goes, the people who didn’t like it will find incidents where a mentally ill person was either unable to defend him/herself. Or an instance where a mentally ill person went off the rails again and shot people.

first time was up in a very nice side of town. A friend of mine threw a little party at his parent’s huge-ass place near a golf course. He just got back to Houston from graduating at Colorado State. Their backyard sort of blends into the golf course through the tall pines. We were not too far from the house in the woods. Us being me, a Mexican, my friend and his siblings/cousins darker Vietnamese, and my friend’s Indian girlfriend. All of a sudden a brand new Silverado crew cab comes towards us. It is night time of course so we just assumed it was security for the golf course. Nope. 4 older well dressed men with 2 ARs and 2 M4s exit the truck weapons drawn, “what the hell do you think you’re doing around here?” WTF? my friend was telling them that we are just hanging out and that his parent’s house was right there. One of them fired a weapon in the air then they all lowered them slowly, pointing them at us. We are flipping out telling them that he lives here, that’s their house and we are just hanging out. They told us to walk back home. We had to walk in front of the truck towards the house. I was just thinking, “aaww FUCK they are going to shoot us in the back” They then just drove by.
Next time not too long after, a group of friends went to play some baseball on an epic sunny day. It was a Sunday and a lot of the parks were already filled with people using their fields. We went to a park a little out of the city towards the petroleum refineries. It is a bit hidden in a long 2 way street into the woods but they have 3 clean fields since it is a city park and they had just given it a good run through. There was only one other group of people there making something on the grill and using the volleyball sand box. We headed towards the baseball field and were just scrimmaging Sandlot style. That other family left and it was just us. Later on, 2 white Silverado 4x4s (older, beat up) showed up and pulled right next to our cars. A bunch of drunk looking dudes came out and without any hesitation shouted, “hey you fuckin little beaners, get out of our park” WTF? Once again, one of the dudes took out a little 9mm and shot towards left field then pointed at us and shouted, “get out!!!”
The next time a group of us were working on the roof of a little shopping center fixing the A/C of dance studio and a shoe store. Around 4:30ish when we were done and just cleaning up our stuff this one crazy old dude pointed a revolver at us saying, “don’t fucking move, i’m calling the cops!” WTF? We were telling him that our work truck is out back and we’re with X company fixing the A/C. “Shut the fuck up you mother fucking pieces of shit liars, I know you’re stealing shit, it’s obvious! The cops are on the way.” Once the police got here, they told this old fucker to put his gun down. He said, “they are up there stealing something, arrest them!” They got control of this old fuck and we came down. Turns out the guy lives in the neighborhood behind the shopping center and has no business ties with the shopping center. Playing the good guy with a gun role.
The next time is hella long and i’m at work. Basically it was at a Denny’s parking lot on the seawall in Galveston. They treated us like shit the whole time. As we were leaving, the manager? or someone in charge plus the security guy ran of the place weapons drawn at me and girlfriend at the time. “Return the cash drawer now!” WTF? Long story short, they both got arrested after the real police arrived.

Holy shit! I can’t imagine having to deal with any of that. Sorry for all the assholes being assholes to you just because you’re not white. I don’t understand some people. I can’t imagine drawing a gun on someone, even if I thought they were up to no good. Unless someone is clearly in immediate danger, just call the cops if you think something looks suspicious (even if you’re a racist asshole who’s definition of suspicious is “not white”).

Here’s the thing though, assault rifles were already banned (ALL of them) in 1986 ( https://en.wikipedia.org/wiki/Firearm_Owners_Protection_Act ). You can not own an assault rifle manufactured after 1986 in any state in the US if you’re a civilian. Period, no loopholes, nada, nothing. People can apply for a NFA permit to own assault rifles built before 1986 however you also need about $10k-$40k to purchase said assault rifle so it’s out of reach of your average joe.
“Assault weapons” are semi automatic rifles that have specific cosmetic similarities with assault rifles. “Assault weapon” is a term put together by politicians who want to look like they’re tough on guns but all it really does is stop me from putting a collapsible synthetic stock with a pistol grip on a ranch rifle (like seen in the picture of my other reply). Now mind you that picture I showed of those two rifles are pictures of a Ruger Mini-14 which is basically the exact same rifle as the dreaded AR15, it will take the same size rounds(.223) and fire them at the same rate of fire.

If that’s case, I seemed to have missed the nuance you mentioned when I read into the issue. I am not as familiar with guns as you are.
That makes me hate both parties, tbh. Democrats for proposing such a gutless and/or incorrectly focussed bill and Republicans for refusing to concede even that 1/16th of an inch.
I’m all for measures that keep guns out of dangerous people’s hands though.
