So, the other day, our family car was brought in for service. We left the dash cam inside it, and I found that it captured everything when we got the car back. Thankfully, nothing heinous was committed (it’s not like we drive a GT-R or anything). However, I did save the videos and edit them into one cohesive video, and I am pretty happy with the way it came out. It’s sort of a behind-the-scenes of what you normally don’t get to see (the workshop, car wash, and all...). Naturally, I would like to share it publicly on a site like YouTube. Is this legal? Thanks in advance.

Note: I turned the dash cam audio recording setting to “off”, so it only recorded video (no audio).

Do you think it would be okay, though? It doesn’t focus on anyone, nor does it reveal anything secretive. Plus, I’d imagine that they’d disconnect it beforehand...?

Laws can vary by state. It might also make a difference if the video has an audio track or not.

NY. No audio besides a song that I put in (which mutes out the rest).

Music-wise, it should be fine, but YouTube will notify me if it does need to be changed due to copyright. I’m not concerned regarding that.

Actually the laws vary by state, but if you’re in a 2 party consent state, it could potentially be an illegal recording. I’m not a lawyer, but it comes down if the shop and/or their staff has an expectation of privacy in the back of the house.

I think you’re on too something. Some kind of an app that reviews places, but instead of someone’s opinion like Yelp. It’s just short hidden camera clips of the place!

Thanks so much for your input. It’s just a small clip that I thought would look cool. I’ll proceed with uploading it to YouTube (and sharing it to Oppo when I do, of course). If any problems arise, and they request that I remove it, then I will do so.

Hm. I’m afraid I’ve only familiarized myself with Michigan laws, but FWIW...

There are two main things that you might need to concern yourself with here. First is that this was on private property (as opposed to public roads, where of course you can film whatever happens). The second is regarding consent. I don’t know if your state requires one- or two-party consent, but just to be on the safe side, you might want to discuss it with the service manager and offer to let him view the footage before granting you permission. I don’t know if that’s being overly cautious or not, but this is kind of a sensitive topic these days and I’d hate to see you get in trouble over what sounds like a rather harmless thing.

Thank you for your consideration. I see the concern with private property, and do find it valid. In addition, I do think my state is one that does not require two-party consent. My plan is to go ahead with uploading the video (which does not focus on any faces, nor does it have any sound besides a music track), and if a problem arises and the dealer would like me to remove the footage, I will most definitely do so at their request.

For this very reason I make sure dash cams are turned off in cars I service. Not because I’m trying to hide anything but because no one has asked for permission and clients sometimes get weird about standard acceptable practices and overly critical of inconsequential details. I’m happy to show, demonstrate, explain anything a client asks about but I would be very upset if they recorded me without my permission. Depending on circumstances and the client themselves, I may go so far as to not allow them back. It’s a serious breach of trust.

Really enjoyed the video, not sure how much editing you ended up putting into it but the end effect is (ahem *blushes*), for real, captivating.

The solid tune track doesn’t hurt, either

In here late but as a lay bystander a couple things stand out, like, *immediately*:

-on private property, maybe; but it is a public arena and situations where no reasonable person would ever have any expectation of privacy.

-No one in the video could easily be personally identified by a viewer watching the video in a customary and usual manner

-It doesn’t really show anyone performing any actions in a specific, identifiable way; like, the service tech can’t claim his work was “spied on” cuz it doesn’t even show what he does, nor anyone else... One could claim, it just shows people moving about. Although, like all art, it’s far, far more than just that, or the sum of its parts :)

Hope this may be of additional reassurance & encouragement.

Is Oregon a two-party consent state? CA is which why the last time I had to bring my car into the dealer (for an emissions campaign with the state now requires to be done to register your car) I put a notice in the car saying that by operating the vehicle they consent to being filmed both visually and via audio. This particular dealer has a history of damaging my vehicle and then lying about it later. They ended up not moving my car at all and did the ECU programming in the drive. Fine by me.

If you got an anal ass like me would you just refuse to work on it if the customer wouldn’t permit you to turn off the camera while working on the car?

And one final note, I would do the same as you and turn off any dash camera in a car I was working on as they hadn’t asked for my permission, therefore I don’t have to let them film me.

As others have already said, it comes down to whether your state is a one or two party consent state. If you’re a one party state then you are allowed to film and post any video. If you’re a two party state then you may not post anything filmed while in the service department, as there is a reasonable expectation of privacy from the public. My advice if you’re a two party state, put a notice in your car when you drop it off that says “by operating the car you consent to being filmed both visually and via audio.” if they’re not doing anything bad they shouldn’t care.

I don’t honestly know. And frankly, until I get sued for it I don’t care.

I wouldn’t refuse to work on it unless the customer was a dick about it. If they ask respectfully I probably wouldn’t have a problem with it. We have nothing to hide. But if they do see something they don’t like I would ask and expect them to talk to us about it before roasting us on the internet over something people maybe just don’t understand.
