Kinja'd!!!

There are several of these at the edge of a roughly 2-acre field behind a medical building. Ok, so they don’t want people walking their dogs back there, got it. But what does the “Trespassers Take Notice” mean, exactly? Are you supposed to... take notice of the No Dog Rule if you’re... trespassing? Or will someone else take notice if your dog is trespassing? And wait, trespassers? I know the field isn’t closed to the public, and in fact a local preschool program has their kids out there on a regular basis. So... WTF.

Modified Commanche for your time.

You can trespass as long as you don’t have dogs? Friendly guy, but has a severe dog allergy?

It is private property where the owner doesn’t mind the public using their land, so trespassers are technically allowed--but they don’t like dogs there?

Maybe they don’t want trespassers to feel judged and unwanted? The world takes a dim view of trespassers, so maybe this field is a safe place for them.

“No tresspassing - I REALLY FUCKING MEAN IT IF YOU HAVE A DOG YOU ASSHOLES”

In all seriousness, since trespassing depends to a point on cleared classes and/or groups of people (who *is* allowed access), I think putting up a sign barring dogs technically means anybody with one runs afoul of the trespassing statute. However, IANAL.

Yeah, it’s very strange. Not private property and people are allowed to use the field... so what’s with the sign at all? Very unclear.

I’m no lawyer either, but I do know that poorly written signs make for difficult enforcement of rules.

Tresspassers take notice is a nicer way of saying “No Tresspassing”.

In a nutshell, without the sign anyone could wander around on the private property and if the land owner wanted them gone they would have to call the cops and have a trespass warning issued to the tresspasser. If after being warned the tresspasser were to return they could then be arrested and charged with trespassing.

With posted No Tresspassing signs at the edge of the property (or Tresspassers take notice, in this instance) the property owner can call the cops and have the tresspasser arrested on the first offence.

This sign in particular gives me the impression that they don’t mind tresspassers, per se, but if you disobey their no dogs policy they reserve the right to call the cops and have you arrested for treaspassing.

Chances are they got tired of dealing with dogshit.

I’d take it to mean ‘Trespassers take this notice with you when you go trespassing’, so I don;t think those signs will be around for long...

Depending where you are, typically trespassing carries different penalties based upon whether the trespasser knows they are trespassing, or doing things that the landowner doesn’t want. This sign A) notifies them that it’s private property, and B) dog walking is specifically not allowed. That changes the discussion when the cops are called to a person playing frisbee with a dog from “hey, you can’t be here, it’s private property”/”Oh, I’m sorry, I didn’t know” to “Hey, you’ve ignored signs and are still trespassing, now the discussion involves getting arrested”.

I only ever see these signs on local freeways:

Kinja'd!!!

Not on highways. Not in town.

As if it only applies where posted.

As if it’s not already the law.

The hell of it is, poor wording often comes down from the statute in question. E.g. statute permits him to state that no dogs are allowed because poo, statute classifies presence of unwanted people as trespassing, other part of statute requires that any anti-trespassing signs state what they are - WHAM! Instant situation requiring an odd sign, because written structure of law.

It’s not “private” although it’s owned by the local hospital... whatever kind of company that is.

It’s a little like, “Trespass at your own risk?” But why not just say that?

I think your interpretation is right. In an effort to make a sign as simple as possible, they obscured its actual intent, which is most likely to reserve the right to kick you out of this field at any time. It’s a medical building, shared by a few different offices - optical shop, eye doctor, physical therapy, some other stuff. So probably no single occupant of the building really cares at all what goes on out there.

But because people are often there with significant others waiting for an appointment, I could easily see “Hey honey I’ll just bring the dog while I wait for you in your appoitment, he can run around [and have a nice dump] in that big field right there!”

I’d say it’s kind of like you guys can come in here, no problems with that... just know that you are technically trespassing, and we WILL be all over you like pigs in mud if you bring dogs.

It dawned on me that because this is adjacent to a medical building, everyone who drives someone to an appointment would bring the dog along for a walk while they waited for their friend/significant other to have their appointment. They don’t mind people walking out there, but it just kind of says, if we want to kick you off of this property we can because we warned you.

Just got a note from my HOA about someone on another street leaving dog waste behind one of the rental buildings on the other side of the community.

The interesting part was that they reminded everyone of their pet policy: If you’re found in violation of the pet policy, you will be given three days’ notice to remove the pet from your property. Three days!

Kinja'd!!! "Wacko" (wacko--)
01/25/2017 at 11:37, STARS: 0

what is the pet policy exactly?

no pets? if so then 3 days is good since you knew you were in violation from the start.

Usually signs say ‘Police take notice’. Not sure why they would want trespassers to notice other trespassers with dogs.

It’s something along these lines: Up to 2 pets, or up to one pet if it’s above 20lb. Clean up dog waste, use a leash, etc etc.

There are a few other, more asinine regulations ($100 fine for leaving your trash can outside! Threatening to tow operable vehicles from driveways!) but still it seems wild to suggest that 3 days is adequate notice if a pet isn’t violent or actually harmful.
